TX 77074 <br />Dear Jim: <br />Thank you for your letter dated April 3. 1995. I am sorry that my <br />response has taken so long- I did verify in early April, in the <br />presence of Mr- Ernest Truiillo Sr., noise readings at several <br />locations of the mine blowers- Mr- Truiillo used a Quest, Model <br />2700, Sound Level Meter- In my opinion, the sound readings taken <br />did exceed the maximum permissible noise level according to <br />Colorado Revised Statutes 25-12-103 for a residential zone- Upon <br />completion of noise testing done that day, I asked Mr. Truiillo if <br />I could use this meter and do my own independent testing. He agreed <br />to lend me the Sound Level Meter- Enclosed are my independent <br />readings for your information. If you compare my readings to the <br />Las Animas County Health Department readings, there is a <br />substantial difference- <br />After comparing these readings, I made several calls to determine <br />the ability and quality of the Quest, Model 2700, Sound Level <br />Meter- This meter does meet or exceed A-N.S-I- (American National <br />Standards Tnstitutel and I-E.C- (International Electrotechnician <br />Commission) for sound testing- I also talked to a technician £rom <br />Quest Technologies, Mike Wurm, who highly recommended and attested <br />to the accuracy of these meters- I also read thoroughly file <br />instruction booklet for this meter and I calibrated it before I did <br />any readings- Therefore, I can attest to the accuracy of these <br />readings- <br />Las Animas County operates on a five part Zoning Regulation System <br />which includes Urban Residential, Rural Residential, Ranchette, <br />Agricultural, and Planned Unit Development- To operate a business <br />in Las Animas County, we follow a certain procedure which is called <br />a Conditional Use Permit- In the case of Basin Resources.Inc-, they <br />do have a Conditional Use Permit which was inherited by purchasing <br />the mine. As long as the original Conditional Use Permit is <br />consistent with the original application for a Special Use Permit, <br />no new permit is required, unless stipulated otherwise by a <br />Resolution from the Board of County Commissioners. <br />Michael A.
