<br />-2- <br />Violations, abatements, dispositions, and civil penalties incurred by Chimney <br />Rock Coal Company from November 12, 1982 through August 31, 1983 were as <br />follows: <br />NOV 83-5 February 8, 1983. Failure to submit the information required by <br />permit stipulations 13, 20, and 22 by the required timeframes. <br />The information was due February 6 and was submitted February 9. <br />Final Civil Penalty: $1,050.00 <br />NOV 83-6 February 8, 1983. Failure to adequately mark the permit <br />boundary. As a result, surface coal mining operations were <br />being conducted outside of the approved permit area. The area <br />was flagged off and equipment kept out. <br />Final Civil Penalty: $1,100.00 <br />NOV 83-10 March 23, 1983. Operator failed to comply with the terms of the <br />approved permit. Specifically, sedimentation Pond 004 was <br />constructed closer to the ephemeral drainage channel that <br />approved. The toe of the outslope of the embankment is less <br />than 4 feet from the centerline of drainage. The pond has been <br />reconstructed so that the outside toe of the west embankment is <br />40 feet from the centerline of the ephemera] drainage channel. <br />Final Civil Penalty: $ 900.00 <br />NOV 83-40 August 19, 1983. Auger mining outside of the approved mining <br />limit (right-of-way of State Highway 151). Abated by ceasing <br />mining outside of limit and maintaining records of depth of each <br />auger hole. <br />Civil Penalty Proposed 9-16-83 $1,400.00 <br />Final Civil Penalty (Conference of 10-18-83): $ 800.00 <br />Date Paid: 12-29-83 <br />NOV 83-29 October 7, 1983. Failure to provide documentation that adequate <br />bonding will be available for the site past the expiration date <br />of the existing band. <br />No Civil Penalty. <br />Violation abated January 16, 1984. <br />NOV C-84-014 February 23, 1984. Failure to protect topsoil. Spoil material <br />placed over reclaimed area in east pit. <br />Proposed Civil Penalty: $1,725.00 <br />Final Civil Penalty: $1,100.00 <br />Date Paid: 06-08-84 <br />Violation Terminated: 05-30-84 <br />NOV C-84-021 March 1, 1984.
