<br />Eight violations were issued on November 10 and 11, 1982 as follows: <br />82-50 Conducted mining activity outside of the approved mining limits. <br />82-52 Failure to store salvaged topsoil so that it will not be <br />disturbed by mining operations and so that it will be protected <br />from wind and water erosion, unnecessary compaction, and <br />contamination. <br />82-53 Failure to salvage topsoil. <br />82-54 Failure to adequately mark topsoil stockpiles. <br />82-55 Failure to comply with the terms of the approved drainage <br />control plan. As a result, runoff from the disturbed area was <br />not flowing through a sedimentation pond. <br />82-56 Failure to contemporaneously reclaim. <br />82-57 Failure to keep storage truck containing explosives locked and <br />closed when responsible personnel are not present. <br />82-58 Failure to reseed or stabilize topsoil stockpiles. <br />After an Assessment Conference on January 18, 1983 and a Board hearing before <br />the Colorado Mined Land Reclamation Board ("Board") on March 24, 1983, final <br />disposition of each of these violations was as follows: <br />82-50 The pit was backfilled during April, 1983. <br />Final Civil Penalty: $2,000.00 <br />82-52 This violation was combined with NOV's 82-53, 82-54, and 82-58 <br />during the January 18, 1983 Assessment Conference. The topsoil <br />piles were dressed and seeded by February 7, 1983. <br />Final Civil Penalty for combined NOV's 82-52, 82-53, 82-54, and <br />82-58: $2,000.00 <br />82-53 and <br />82-54 See NOV 82-52. <br />82-55 The drainage control plan was approved and implemented. <br />Final Civil Penalty: ;1,700.00 <br />82-56 New reclamation timetables were submitted and approved. <br />Final Civil Penalty: ;1,700.00 <br />82-57 Vacated by Board <br />82-58 See NOV 82-52. <br />
