On July 24, 2000, Colowyo Coal Company L.P., requested <br />revision or an amendment to the Special Stipulations at Sec. 31(e), (f), (h), and (i) <br />because they are no longer applicable to the coal mining operations foreseen in the <br />Green River-Hams Fork Enviroranental Impact Statement approved February 29, 1980. <br />The Little Snake Field Office (LSFO) conducted resource reviews to evaluate the <br />impacts of revising the stipulations. These actions would temporarily exempt the <br />lessee from complying with stipulations no longer relevant to current operating and <br />environmental conditions. The LSFO concludes that based on the Documentation of Land <br />Use Plan Conformance and National Environmental Policy Act(NEPA) Adequacy (DNA), this <br />proposal conforms to the applicable land use plan and the NEPA documentation fully <br />covers the proposed action and constitutes BLM's compliance with the requirements of <br />NEPA. Therefore, we have determined that stipulations at sec.31 (e), (f), and (i) may <br />be temporarily exempted until all stipulations are re-addressed at lease readjustment <br />due in April and June, 20D3. We have also determined that exemption of sec. 31(h) is <br />not suitable at this time as it does not appear that the stipulation will affect lease <br />operations. However, if lease operations are affected in the future, an exemption <br />could be considered on a site specific case-by-case basis. <br />We enclose a duplicate copy of this decision. Under Sec. 31 of the lease, <br />stipulations may be revised or amended, in writing, by mutual consent of lessor and <br />lessee. To properly document our records, we request that an authorized officer of <br />Colowyo Coal Company L.P. indicate acceptance of the exempted stipulations at <br />Sec. 31(e), (fl, and (i) by signing both decisions where indicated and re[urning the <br />duplicate copy of the decision to th~s offic~ <br />J s E.
