Dear Mr. Lamoreux:
In response to your letter of September 6, 1989, I have attempted to outline
the reclamation plan requirements in somewhat more detail than in my letter
of August 21, 1989. If you wish, we would be happy to schedule a meeting to
discuss any further questions or concerns you might have in regard to this
project.
You requested a "specific statement of what the State requires of the
reclamation of this project". The reclamation will have to be completed in
compliance with the reclamation plan as specified in the "La Plata No. 1
Permit Application" and the "Proposed Decision and Findings of Compliance for
the La Plata No. 1 Mine". The referenced documents were sent to you with the
letter of August 21, 1989. These documents may not set forth in sufficient
detail the specifications necessary for the preparation of contracting
documents. It would be the responsibility of the surety to obtain the site
data necessary to prepare sufficiently detailed contracting specifications.
I have attached a site topographic map which was prepared based on a survey
of the portal bench and facilities area which we performed (Attachment A).
The map may be of some assistance to ,you. We a]so have aerial photographs
of the site which are available for viewing in our office.
The bank also needs to be aware that the period of responsibility for
revegetation under the bond will extend fora period of at least 10 years
following the last year of augmented seeding, pursuant to Rule 3.02.3(1)
and (2) of the Coal Re_aulations (Attachment B). Bond release criteria and
procedures for seeking bond release are outlined in Rules 3.03.1 and 3.03.2,
Sediment control facilities will need to be maintained until a satisfactory
stand of vegetation has been established, as specified in Rule 4.05.2(1) and
(2) (Attachment C).
You requested guidance on specific requirements pertaining to the issues
listed in the August 21, 1989 letter. Most of the issues are addressed
with varying degrees of specificity within the permit application text and
exhibits, as well as the Findings Document. We have provided more detail on
a number of the tasks, below.
