Each pit will be sampled once during the 1988 growing season and <br />once at each five year interval thereafter until bond release. <br />8. Sediment ponds at Pits 2, 3, and 4 will be reclaimed in accordance <br />with Rockcastle's letter of December 7, 1984, and in compliance <br />with Rule 4.14.1(2)(a) which specifies that spoil be "graded to <br />eliminate all highwalls, spoil piles and depressions." <br />9. Rockcastle will use both preventive and remedial actions to control <br />rills and gullies at the Grassy Gap Coal Mine. Such methods will <br />include installation of a series of contour furrows along reclaimed <br />surfaces and, on particularly steep slopes or areas where rill and <br />gully formation is known to be a problem, a combination of contour <br />furrows and diversion ditches will be used. <br />When excessive rills and gullies are observed, the applicant will <br />stabilize them by filling, compacting where appropriate, and <br />reseeding. Where necessary to allow for stabilization, diversion <br />ditches will be constructed above the eroded areas. <br />B. Stipulations 1-13 of the Proposed Decision are hereby deleted. The <br />following stipulations will be included in the Final Decision: <br />STIPULATION N0. 1 <br />WITHIN 30 DAYS OF PERMIT ISSUANCE, THE APPLICATION TEXT MUST BE UPDATED <br />TO REFLECT ACTUAL CONDITIONS AT THE MINE, AS DEPICTED ON THE MINING <br />PLAN MAP SUBMITTED MAY 4, 1984. (This was proposed Stipulation No. i0.) <br />STIPULATION N0. 2 <br />WITHIN 6 MUNTHS OF PERMIT ISSUANCE THE PERMITTEE WILL SUBMIT TO THE <br />DIVISION APPROPRIATE STABILITY ANALYSES FOR HAUL AND ACCESS ROAD CUT <br />SLOPES WHICH EXCEED THE DESIGN RESTRICTIONS OF RULE 4.03.1(3)(c)(i) AND <br />RULE 4.03.2(3)(c)(i) ANO REMAINING SLOPE SEGMENTS WHICH CURRENTLY <br />EXHIBIT SIGNS OF INSTABILITY. IF THE DIVISION DETERMINES THE ROADS TO <br />BE UNSUITABLE FOR THE POSTMINING LANG USE BASED ON THOSE ANALYSES, <br />APPROPRIATE DESIGN MODIFICATION OR STABILIZATION PLANS WILL BE <br />SUBMITTED TO THE DIVISION WITHIN ONE YEAR OF PERMIT ISSUANCE. (This is <br />a modification of proposed stipulations 11 and 12.) <br />STIPULATION N0. 3 <br />AN ACCEPTABLE BOND, IN THE AMOUNT DETERMINED BY THE BOARD TO BE <br />APPROPRIATE, SHALL BE POSTED WITHIN 30 DAYS OF 7HE FINAL DECISION TO <br />ISSUE THE PERMIT AND PRIOR TO PERMIT ISSUANCE. (This was proposed <br />Stipulation No. 13.) <br />
