<br />Introduction <br />The Division of Minerals and Geology (Division) received an application from the Eastside Coal <br />Company, Inc. (Eastside), for the 3`d renewal of Permit C-84-063 to conduct coal mine reclamation <br />activities a[ the Eastside Mine (application). This document is the decision package prepared by the <br />Colorado Division of Minerals and Geology (Division) on the application. This document includes: <br />I) the proposed decision to approve the application for renewal; 2) a summary which includes a <br />history of the review of the application, a description of changes made to the PAP under this renewal <br />action, a description of the environment affected by the operation and a description of the mining <br />and reclamation plan; and 3) the written findings of compliance the Division has made as required <br />by the Colorado Surface Coal Mining Reclamation Act and the Regulations of the Colorado Mined <br />Land Reclamation Board for Coal Mining. The Regulations of the Colorado Mined Land <br />Reclamation Boazd for Coal Mining (Rules) contain the complete text of rules referenced throughout <br />this Findings of Compliance document. <br />The Eastside Mine is in permanent cessation. No coal production is envisioned during the permit <br />renewal period. Reclamation work and monitoring activities are proposed operations, and are to be <br />accomplished by Eastside. <br />The mine is located on private lands within Garfield County. The legal description of the lands <br />included within the permit area is: <br />Section 24, TSS, R92W, 6'h P.M., Garfield County, Colorado, more specifically described as <br />follows: Commencing at a point which bears S6°25'08"W, 483' +/- from the NE comer of <br />Section 24, thence south a distance of 905' +/-; thence S89°27'34"E a distance of 260' +!-; <br />thence south a distance of 975' +/-; thence west a distance of 4160' +/-; thence NS°23'22"E a <br />distance of 2662' +/-; thence S80°04'26"E a distance of 2030' +!- to the point of beginning. <br />It is located in the Harvey Gap Drainage, approximately 3 '/z miles north of Silt, Colorado, and <br />approximately 1500 feet downstream from the Grass Valley Reservoir. The site of the portals and <br />surface facilities (reclaimed) is located on the east side of the Harvey Gap Drainage, opposite County <br />Road 237. The area of the permit is on USGS 7.5-minute topographic map Silt quadrangle. <br />Proposed Decision <br />The Division proposes to approve the renewal application for the valid, existing Permit C-$4-063 <br />for a period of five years, beginning on January 13, 2000, and expiring on January 13, 2005. This <br />proposed decision approves the continuation of current, previously approved reclamation activities <br />of the Permit for the ensuing permit term. This proposed decision to approve the application is based <br />on a finding that the operations will comply with all requirements of the Colorado State Program as <br />found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq., and the <br />Regulations promulgated pursuant to the Act. If no request for a formal hearing is made within thirty <br />(30) days of the first publication of the issuance of this proposed decision, then this decision <br />becomes final. The permit application, all supporting documentation and any stipulations or <br />conditions will become a binding part of the permit. <br />03/06/GO <br />
