IX. Coal Mine Waste <br />There is no proposed disposal of coal mine waste during the ensuing term of the permit. <br />However, the disposal of coal mine wastes was approved during previous terms of the permit. <br />Some wastes were disposed of underground. No surface sites were used. See Paragraph VII.B. <br />above. The Division makes no approvals relating to 4.11.1, 4.11.2, 4.11.3, 4.15, 4.11.4(2), <br />4.1 l.5(3)(a), and 4.11.5(1)(b). <br />X. Backfilling and Grading <br />All backfilling and grading work has been accomplished at the site in accordance with a <br />previously-approved reclamation plan. Therefore the Division makes no approvals for the <br />ensuing term of the perrriit relating to backfilling and grading of 4.05, 4,06, 4.09.1, 4.14.1(1), <br />4.14.1(2)(d), 4.14.1(2)(e), 4:14.1(2)(f)J, 4.14.1(2)(f)(i)-(v}, 4.14.1(2)(g), 4.14.1(2)(g)(i)-(v), <br />4.14.2, 4.14.2(2), 4.14.2(3), 4.14.3(1)(a), 4.14.3(2), ,4.15, and 4.27. <br />XI. Revegetation <br />With the exception of the sedimentation pond and diversion ditches, all disturbed areas to be <br />reclaimed have been vegetated. <br />A. The Division proposes to perpetuate the previously approved use of introduced species <br />in the reclamation seed mix, The applicant has submitted information which shows that <br />the introduced species are desirable and necessary to achieve the approved post-mining <br />land use, and aze not poisonous or noxious [4.15.2(3)]. <br />B. The Division proposes to perpetuate the previously approved use of mulching as <br />means to meet soil stabilization requirements (4.15.4). <br />C. Disturbed areas of the site were disturbed bypre-permit (historic) mining activities. The <br />Division proposes to perpetuate the previously approved vegetative standard of 35% <br />cover, determined by a statistically valid point intercept sampling technique [4.15.7(1), <br />4.15.7(2), and 4.15.8(1)(b)]. Therefore, the Division makes no approvals with regard <br />to 4.15.7(3), 4.15.7(4), 4.15.8, 4.15.8(3), 4.15.8(4), 4.15.8(7), 4.15.9, 4.15.10, and <br />4.15.10(3)]. <br />XII. Post-mining Land Use <br />The Division is proposing to perpetuate the previously approved post-mining land use of <br />rangeland. Therefore, the Division makes no approvals with regard to an alternative post- <br />mining land use (4.16.3). <br />XIII. Protection of Fish, Wildlife and Related Environmental Values <br />A. The applicant has not proposed the use of persistent pesticides on the site during the <br />ensuing term of the permit.
