<br />detention 12,000 cubic feet (0.03 acre feet) (PAP Drawing 3, Sediment Pond SP-1) of <br />surface waters on the site. There is no water consumption proposed for the remaining <br />reclamation operations at the site. Therefore, the Division finds that the application <br />poses no, or a potential for insignificant, impact on the quality or quantity of surface <br />waters. <br />The alluvial aquifers below the mine are isolated from mine groundwater by impervious <br />layers and distance. The alluvial aquifers are exposed to potential surface water runoff <br />from the disturbed areas of the mine. However, there have been no such discharges to <br />date, and any discharges would be processed through a sedimentation pond, and are not <br />derived from areas of toxic or acid-forming soils. Therefore, the Division finds that the <br />application poses no impact on the quality or quantity of alluvial ground water. <br />The Probable Hydrologic Consequences section of the original findings document <br />predicted negligible ground water impacts. There have clearly been no detectable <br />hydrologic impacts, based on study of Annual Hydrologic Reports submitted by <br />Eastside Coal Company from 1984 through 1998: Due to the extensive periods of <br />inactivity, very little mine development has taken place at Eastside. For the same <br />reason, there has been little or no hydrologic impact during the first three permit terms. <br />The Division finds that there would be no, or insignificant, probable hydrologic impacts <br />from approval of the application. <br />N. Topsoil <br />A. Prior to issuance of the initial permit, all the areas of surface disturbance at the site had <br />been previously disturbed by (historic) mining activity. The Division determined that <br />there was no topsoil on the areas of surface disturbance. Thus the Division makes no <br />approval of provisions for the protection of topsoil [4.06.1(2)]. <br />j <br />B. No additional clearing of vegetation or removal of topsoil is proposed. Thus the <br />Division makes no waiver of requirement for clearing of vegetation cover prior to <br />topsoil removal [4.06.2(1)]. <br />C. No removal of topsoil is proposed. Thus the Division makes no approval of a variance <br />for topsoil removal [4.06.2(2)(a)]. <br />D. No additional earthwork (other than reclamation of the sedimentation pond and <br />diversion ditches) is proposed (no new disturbance). Thus the Division makes no <br />approvals regarding segregation of B horizon and C horizons [4.06.2(3)]. <br />E. The Division has determined selected overburden materials shall be used for topsoil <br />(seed bed material) for reclamation of the remaining surface facilities (as was done for <br />previous reclamation). This determination is based on physical and chemical analyses <br />approved by the Division [4.06.2(4)(a)]. <br />15 03/06/00 <br />
