9. No specification of a lesser road grade is approved by the Division [4.03.3(3)(a)]. <br />II. Support Facilities -Rule 4.04 <br />The permit is in cessation and reclamation. No new support facilities are proposed during <br />the ensuing term of the permit. No past or existing support facilities incurred damage, <br />destruction, disruption of oil, gas, or water wells or pipelines, coal slurry pipelines, <br />railroads, or utility lines (none passed over, under, or through the permit area). Therefor, <br />no written approval from the owner of such facilities were received by the Division, and <br />no approvals by the Division were granted [4.04(b)]. <br />III. Hydrologic Balance -Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations <br />No exemption to the use of sediment ponds and/or treatment facilities to meet the <br />effluent limitations of 4.05.2 and the applicable State and Federal water quality <br />requirements for downstream receiving waters was submitted or approved by the <br />Division for the major portion of surface areas of disturbance [4.05.2(3)(a)]. <br />2. The Division proposes to perpetuate apreviously-granted small area exemption <br />from use of sediment ponds due to the limited size of the pre-disturbed office <br />area and due to the fact that ponds and treatment facilities are not necessary for <br />the drainage to meet the effluent limitations of Rule 4.052 and applicable State <br />and Federal water quality standards for receiving streams, and also due to the fact <br />that no mixing of surface drainage with a discharge from underground workings <br />will occur [4.05.2(3)(b)(i)]. <br />3. There is no drainage from underground mine workings at the site. Therefore no <br />exemption from use of sediment ponds for drainage from undergrour"id mine <br />workings is considered [4.05.2(3)(b)(ii)]. <br />4. There is no water discharged from the site with a pH of less than 6.0. Therefore <br />no use of manual lime feeder or other neutralizing agent for the treatment of <br />water is considered [4.05.2(8)(a)]. <br />B. Diversions and Conveyance of Overland Flow <br />There are no diversions of perennial or intermittent streams in the permit area. <br />The Division proposes to petperuate the previously-approved use of a grass-lined <br />channel across reclaimed areas and two riprap relief drains off the facilities area <br />terrace to the Harvey Gap Drainage. The linings provide stability in order to <br />protect the reclaimed area, reduce potential for gully erosion off the terrace, and <br />reduces danger to public health and safety [4.05.3(3)]. <br />2.
