<br /> <br />coal processing waste pile of subsidence resulting from underlying <br />pre-existing underground workings. This stipulation was never satisfied <br />and is included in this document as Stipulation 3 under Section XVIII. <br />With the acceptance of this stipulation, the present and proposed <br />operations are in compliance with the requirements of this section. <br />XXIV, Special Categories of Mining - Rules 2.06, 4.22, 4,23, 4.26, 4.27, <br />4,28. and 4.29 <br />Subsequent to the approval of the permit for the Animas Mine, revisions <br />to the permit were approved allowing construction of three railroad <br />loadouts in the City of Trinidad. There are no other special categories <br />of mining involved at the Animas 14ine. <br />The present and proposed operations are in compliance wit the <br />requirements of this section. <br />XXV. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4,12, 4.19, 4.21, 4.28, <br />and 4.30 <br />Certain modifications in the content of this section of the original <br />Findings are required by virtue of operations changes made in the Animas <br />Mine during the first permit term. The mine temporarily ceased active <br />operations in mid 1984. Proper notice of this was provided to the <br />Division in compliance with Rule 4.20. Although inactive throughout the <br />remainder of the first permit term, the mine continued to comply with the <br />provi si ons of i is permit. <br />Three offsite support facilities, ie. railroad loadouts, were added to <br />the permit area during the first permit term. These were constructed, <br />operated, and have been maintained in compliance with Rule 4.28. <br />Following purchase of the mine by Raton Creek Associates, Ltd., Energy <br />Fuels Mining Company submitted Notice of Intent to Conduct Exploration <br />Activities No. CX-87-154-17. Approval of this was granted August 24, <br />1987. Although the project was to be conducted entirely within the <br />permit area of the Animas Mine, Energy Fuels Mining Company was not the <br />approved pennittee at the time. The application was made and approval <br />granted in compliance with Rule 2.02.2. Performance standards will meet <br />the requirements of Rule 4.21. Performance bonding and bond release will <br />comply with Rule 3.06. <br />The present and proposed operations are in compliance with the <br />requirements of this section. <br />XXV I, Operations on Lands Subject to Prohibitions or Limitations - Rules <br />The content of this section of the original Findings is adequate for the <br />Animas Mine during the permit renewal term. <br />The present and proposed operations are in compliance with the <br />requirements of these sections and Rule 2.07,6(2)(d1(v). <br />-23- <br />
