<br />LATER THAN ONE YEAR FOLLOWING RETURN OF THE MINE TO ACTIVE MINING <br />STATUS. THE OPERATOR SHALL RESTRICT PLACEMENT OF COAL PROCESSING WASTE <br />TO THAT AREA DELINEATED ON THE MAP SUBMITTED AS A SUPPLEMENTAL AMENDMENT <br />TO THE TECHNICAL REVISION APPLIrATION, UNTIL THE DIVISION HAS APPROVED <br />THE SUBSIDENCE SURVEY. IN THE EVENT THAT THE REQUIRED SUBSIDENCE SURVEY <br />WERE TO DETERMINE THAT THE PROPOSED AMENDED COAL PROCESSING WASTE PILE <br />MIGHT POTENTIALLY BE DAMAGED BY ANTICIPATED SURFACE SUBSIDENCE, ENERGY <br />FUELS MINING COMPANY SHALL REDESIGN THE PROPOSED AMENDED EMBANKMENT TO <br />RENDER THE DESIGN ACCEPTABLE TO THE DIVISION. <br />With acceptance of Stipulations 2 and 3, the present and proposed <br />operations are in compliance with the requirements of this section. <br />XIX. Roads - Rules 2.05.3(3)(c)(i) and 4.03 <br />All roads in regular use or anticipated to be so have not been identified <br />and appropriately designated for use in the renewal application. <br />Examples of this include the haul road from the Helen Mine raw coal stock <br />pile to the secondary Run of Mine stock pile and feeder and the access or <br />light use road from the security building to the sediment pond. All <br />designated roads have certain construction, drainage, and maintenance <br />requirements that must be addressed. As a result the following <br />stipulation is made. <br />Stipulation 4 <br />WITHIN 60 DAYS OF APPROVAL OF THE APPLICATION TO RENEW THE ANIMAS MINE <br />PERMIT, ENERGY FUELS MINING COMPANY WILL IDENTIFY ALL ROADS TO BE USED <br />WITHIN THE PERMIT AREA, ASSIGN ACCEPTABLE DESIGNATIONS OF USE FOR THESE <br />ROADS, PROYIDE ACCEPTABLE DESIGN AND CONSTRUCTION PARAMETERS FOR ALL <br />ROADS CONSISTENT WITH THEIR DESIGNATIONS OF USE, AND SUBMIT MAPS <br />ILLUSTRATING THE LOCATION OF THESE ROADS AND THEIR DESIGNATIONS OF USE <br />FOR ALL COPIES OF THE PERMIT APPLICATION IN THE DIVISION'S POSSESSION AND <br />AVAILABLE TO THE PUBLIC. <br />_pl _ <br />
