1
_z - T
Thomas B. Petrosky -2- January 15, 1997
Hayden Gulch Loadout Facility
3. The Division may publish notice and notify you that your required performance bond will
be reduced to account for the removal of costs associated with coal stockpile disposal,
pursuant to Rule 3.02.2(4). If the reclamation cost estimate for your Loadout is
incorporated into your permit application, a revision to the permit would be required to
update the approved cost estimate. If the cost estimate for your Loadout is sepazate from
the permit application, no revision of the permit would be required.
While costs for disposal of coal stockpiles will no longer be included in estimates of reclamation
cost liability, other costs which the State would be likely to incur during reclamation of coal
storage areas at permit-revoked sites will continue to be included in Division cost estimates.
These include costs for clean up and disposal of coolly material in the footprint of any coal
storage facilities, costs for laboratory analysis of mine waste to verify that the material is suitable
for on-site disposal, and costs for proper disposal of any coal materials which aze stored for
extended periods of time without being sold.
Please contact the lead specialist for the HG Loadout if you have questions or need additional
information. They will be happy to discuss your choice of administrative procedures to adjust
the required performance bond for your Loadout.
Sincerely,
.~C~
Susan J.
