Rules 2.03.5(1)(a) and (b) (Statute 34-32-110(2)(fl) <br />Please state whether the information provided in Sections 2.03.5(1)(a) and (b) of the <br />permit is still accurate for Walden Coal Company, for any current subsidiaries or <br />affiliates of Walden Coal Company, and for any persons currently controlled by or <br />under common control with Walden Coal Company. If not, please update. <br />11. Rule 2.03.5(2) (Statute 34-32-I10(2)(fl) <br />Please state whether the information provided in Section 2.03.5(2) of the permit is still <br />applicable. <br />12. Rule 2.03.5(3) (Statute 34-32-114(3)1 <br />The mid-term date for the Bourg Mine's current permit period is October 21, 1995. <br />For the period from October 21, 1992 to October 21, 1995, please provide a list of all <br />violation notices received by Walden Coal Company for any violations of a provision <br />of the Act, of any law, rule or regulation of the United States, or of any State law, rule <br />or regulation enacted pursuant to Federal law, rule or regulation pertaining to air or <br />water environmental protection incurred in connection with the Bourg Mine. For each <br />notice, please provide that information required by Rules 2.03.5(3)(a) through (f), as <br />applicable. <br />For the period from October 21, 1992 to October 21, 1995, please provide a list of all <br />unabated cessation orders and unabated air and water quality violation notices received <br />by any surface coal mining and reclamation operation owned or controlled by either <br />Walden Coal Company or by anx person who owns or controls Walden Coal Company. <br />For each unabated cessation order and unabated notice of violation, please provide that <br />information required by Rules 2.03.5(3)(a) through (f), as applicable. <br />13. Rules 2.03.6(1). (2) and (3) (Statutes 34-32-110(2)(j) and 114(2)(fl) <br />It is the Division's understanding that the current landowner of the property within the <br />permit area at the Bourg Mine site is now Mr. William Bush (619 Viewpoint Drive, <br />Grand Junction, Colorado 81506).
