Cattany <br />Division Director <br />The Division received and reviewed your Januazy 31, 2003 letter regarding improving existing <br />access roads for ranch use on approximately 2,200 acres. You cited Rule 1.2.2 which, you say, <br />exempts you from obtaining a reclamation permit for the road improvement projects on the ranch <br />property because the extracted material is not hauled off-site or sold. <br />First of all, Rule 1.2.2 no longer applies because it was deleted from the Rules in 1996. Second, <br />after inspecting the site on Februazy 12, 2003, the Division determined that the re-aligned County <br />road does not need a reclamation permit (even though the road will be used for the mining <br />activity). And third, I have enclosed a copy of the latest Boazd policy and a copy of the "Need <br />for a Reclamation Permit" for future use if you encounter a situation where you don't know if a <br />reclamation permit is required. <br />If you wish to update the Construction Materials Act/Rule and Regulations you can obtain a <br />copy by submitting a request and a check for $5.00. The documents will be mailed back to you <br />within a week.
