i"^ ti <br />ASSIGNMENT OF RECORD TITLE INTEREST <br />IN A FEDERAL COAL LEASE <br />THIS ASSIGNMENT OF RECORD TITLE ("Assignment") dated December 31, <br />2003 is from Bowie Resources Limited, a Colorado corporation, with an address at 2000 <br />Ashland Drive, Ashland, Kentucky 41101 ("Assignor"), to Bowie Acquisition Group, <br />LLC, a Kentucky limited liability company, with an address at 1500 North Big Run <br />Road, Ashland, Kentucky 41102 ("Assignee"). <br />For Ten Dollars and other good and valuable consideration, the receipt and <br />adequacy and sufficiency of which are hereby confessed and acknowledged by Assignor, <br />Assignor does hereby grant, sell, assign, transfer and set over to Assignee all of the <br />Assignor's 100% record title interest in and to Federal Coal Lease No. COQ036955 (the <br />"Lease"), covering the following lands located in Delta County, Colorado: <br />Townshi~3 South, Ran>;e 91 West, 6`s P.M. <br />Section 17: S/2NW/4, N/2SW/4, SE/4SW/4 <br />Section 18: SE/4NE/4, NE/4SE/4 <br />Containing 280.00 acres, more or less. <br />TO HAVE AND TO HOLD the Lease unto Assignee, its successors and assigns <br />forever. <br />This Assignment is made and accepted without any covenants or warranties <br />whatsoever; either express or implied. <br />This Assignment is expressly made subject to all applicable statutes, rules and <br />regulations including, without limitation, the Mineral Leasing Act of 1920 (30 U.S.C. <br />§ , 181 et seq,) and the regulations promulgated thereunder. <br />This Assignment and all the terms and provisions hereof shall inure to the benefit <br />and be binding upon the parties hereto and their respective successors and assigns. <br />~~;:;=gin szaTes oa= nnnettlv,° t+iAR f 20~~ N <br />r .crl?E?.- ~ RO'JE.^. -C <br />ui. _ <br />Lexlibrary/218085_ I .DOC <br />
