FRIEND. <br /> DISCLAIMER: Plaintiff, VALCO, INC. , specifically <br /> disclaims any and all right, title , or interest in all <br /> lands and rights of way that THE DENVER AND RIO GRANDE <br /> WESTERN RAILROAD COMPANY may own or control , either by <br /> deed or government grant, located within the above- <br /> described property and particularly in Sections 31 , 32 , <br /> and 33 , inclusive, all in Township 20 South, Range 65 <br /> West of the 6th P.M. This disclaimer shall not affect <br /> the validity of any deeds of conveyance between THE <br /> DENVER AND RIO GRANDE WESTERN RAILROAD COMPANY and <br /> VALCO, INC. <br /> DISCLAIMER: CERTIFIED CONCRETE CO . , a Colorado <br /> corporation, as Purchaser, has heretofore entered into <br /> a contract with RICHARD L. DIVELBISS and FLORINE E. <br /> DIVELBISS , as Seller, dated July 2 , 1970 , wherein there <br /> was reserved in the conveyance of certain lands in <br /> Sections 32 and 33 , Township 20 South, Range 65 West of <br /> the 6th P.M. to the said Sellers the following <br /> described rights, to-wit: <br /> "Excepting and reserving to the said RICHARD R. <br /> DIVELBISS , his spouse and children, pasturage and <br /> recreational rights on the said premises which shall <br /> not interfere with grantees specified use with right of <br /> ingress and egress relative for said purposes on said <br /> premises. The Purchaser shall in no way have any <br /> liability to the above parties arising out of any of <br /> its operations upon the premises that may interfere_ <br /> with the recreational and pasturage rights herein <br /> granted and the above parties shall , in the exercise of <br /> such rights, at all times be considered as having <br /> assumed any risk that may be involved by reason <br /> thereof. <br /> VALCO, INC. , a Colorado corporation, Plaintiff herein, <br /> and successor in interest to CERTIFIED CONCRETE CO. , <br /> does acknowledge the aforesaid contract and the terms, <br /> conditions , reservations, and exceptions contained <br /> therein, as specifically described . The aforesaid <br /> terms shall continue in full force and effect and this <br /> quiet title action shall have no affect upon the said <br /> terms, conditions , reservations , and exceptions <br /> contained in the contractual language set forth above . <br /> 4 - <br />
