Markus made no comments on or objections to the release. EFCI was represented by George Pa[tersm <br />and AI Weaver. <br />II. CRITERIA AND SCHEDULE FOR BOND RELEASE <br />Section 3.03.1(2)(a) states, "Up to sixty percent of the applicable bond amount shall be released when <br />the permittee successfully completes backfilling, regrading, and drainage control in accordance with <br />the approved reclamation plan." With regard to Phase I bond release, the approved reclamation plan <br />for the Southfield Mine Loadout calls for regrading the slopes to approximate original contour and <br />establishing drainage to Oak Creek and Chandler Creek. <br />III. OBSERVATIONS AND FINDINGS <br />Backfilling and grading of the site was completed in October 1996. EFCI removed all coal material <br />from the Loadout prior to regrading. All structures were removed at the Loadout except the railroad <br />tracks. The railroad tracks are approved for permanent retention. Regraded slopes conform to those <br />proposed in the currently approved Loadout area postmining topography (Map 29 of the permit <br />application), as demonstrated in Drawing No. SL-01-1 of the bond rel~se application. This was also <br />verified by the Divisionduring the site inspection. The approved postmining topography approximates <br />original contour, and no variances from approximate original contour requirements or highwall <br />reclamation were granted. <br />Drainage at the Loadout has been reestablished, with the exception that the sediment ponds remain in <br />place. The ponds may not be removed until EFCI has demonstrated that drainage from the disturbed <br />areas does not contribute additional suspended solids above premining levels or that of adjacent <br />unmined lands. Once EFCI can remove the ponds and the area is regraded in accordance with the <br />approved postmining topography, drainage will approximate premining configurations. <br />Based upon a review of the mine permit, the applicant's bond release application, and the site <br />inspection, the Division finds that EFCI has completed backfilling, grading and drainage <br />reestablishment at the Southfield Mine Loadout in accordance with the approved reclamation plan. <br />IV. PROPOSED DECLSION <br />Based on the observations above, the Division proposes to approve EFCI's request for a Phase I born <br />release for the Southfield Mine Loadout. This proposed decision will release the applican[ from <br />liability for backfilling, grading, and drainage reestablishment on 14.5 acres at the Loadout. Excepted <br />from the Loadout Area Phase I bond release are the sedimentation ponds. <br />The Division holds a performance bond of $941,423.00 for the Southfield Mine. The portion of the <br />performance bond which pertains to the Loadout is $44,968.00. The Division proposes to release 60% <br />Southfield Mine Phase 1 Bond Release Page 4 <br />
