<br />Pursuant to Rule 2.07 .6 (2)(n) and based on available information, the <br />Division finds that the proposed activities would not affect the <br />continued existence of endangered plant species or result in destruction <br />or adverse modification of their critical habitats as determined under <br />the Endangered Species Act of 1973. <br />The proposed operation is in compliance with the requirements of this <br />section. <br />IX. Post-Mining Land Use - Rules 2.04.3, 2.05.5, and 4.16 <br />The discussion of pre- and post-mining land use in the permit and <br />adjacent areas can be found in Volume I, pages 3-1 through 3-11 and 4-78 <br />of the permit application. <br />The permit area is not within 300 feet of occupied dwellings. There is <br />some surface disturbance at the site as a result of past mining <br />activities. The last mine within the permit area ceased operations in <br />1962. <br />The approved post-mining land uses for the permit area are grazing land, <br />cropland, residential, and wildlife habitat. The majority of the permit <br />area is undeveloped land. <br />Stipulation No. 1 which required the reclamation standard for newly <br />disturbed areas to apply to those areas of old mining disturbance which <br />were redisturbed, was satisfied by a July 29, 1986 revision to the permit <br />page 4-75. <br />The proposed operation is in compliance with the requirements of this <br />sec ti on. <br />X. Protection of Fish, Wildlife and Related Environmental Values - Rules <br />an <br />Fish and wildlife information can be found on pages 3-143 through 3-171 <br />in Volume I of the application. The fish and wildlife protection plan is <br />on pages 4-81 through 4-82 of Volume I. <br />The permit and adjacent area hosts a wide range of wildlife species. <br />This is largely due to the existence of numerous distinct habitats at the <br />mine site. Wildlife which currently inhabits the area may be displaced <br />by surface activities. However, there are many acres of similar habitat <br />surrounding the mine area which can easily absorb displaced individuals. <br />There are no threatened or endangered species which are known to use or <br />inhabit the site. However it is possible that the site is used as <br />hunting grounds for some Peregrine Falcons which nest to the north and <br />east. The Division requested comments from the Colorado Division of <br />Wildlife (DOW), but none were received. <br />-18- <br />
