Pursuant to Rule 2.07 .6 (2)(n) and based on available information, the
Division finds that the proposed activities would not affect the
continued existence of endangered plant species or result in destruction
or adverse modification of their critical habitats as determined under
the Endangered Species Act of 1973.
The proposed operation is in compliance with the requirements of this
section.
IX. Post-Mining Land Use - Rules 2.04.3, 2.05.5, and 4.16
The discussion of pre- and post-mining land use in the permit and
adjacent areas can be found in Volume I, pages 3-1 through 3-11 and 4-78
of the permit application.
The permit area is not within 300 feet of occupied dwellings. There is
some surface disturbance at the site as a result of past mining
activities. The last mine within the permit area ceased operations in
1962.
The approved post-mining land uses for the permit area are grazing land,
cropland, residential, and wildlife habitat. The majority of the permit
area is undeveloped land.
Stipulation No. 1 which required the reclamation standard for newly
disturbed areas to apply to those areas of old mining disturbance which
were redisturbed, was satisfied by a July 29, 1986 revision to the permit
page 4-75.
The proposed operation is in compliance with the requirements of this
sec ti on.
X. Protection of Fish, Wildlife and Related Environmental Values - Rules
an
Fish and wildlife information can be found on pages 3-143 through 3-171
in Volume I of the application. The fish and wildlife protection plan is
on pages 4-81 through 4-82 of Volume I.
The permit and adjacent area hosts a wide range of wildlife species.
This is largely due to the existence of numerous distinct habitats at the
mine site. Wildlife which currently inhabits the area may be displaced
by surface activities. However, there are many acres of similar habitat
surrounding the mine area which can easily absorb displaced individuals.
There are no threatened or endangered species which are known to use or
inhabit the site. However it is possible that the site is used as
hunting grounds for some Peregrine Falcons which nest to the north and
east. The Division requested comments from the Colorado Division of
Wildlife (DOW), but none were received.
-18-
