<br /> <br />III. Hydrologic Balance: Rules 2.D4.5, 2.04.7, 2.05.3, 2.05.4, and 4.05 <br />Surface Water <br />A. Baseline information <br />Information on surface water can be found in the permit application <br />in Sections 3.3.7, 4.2.3, 4.2.4, 4.5.3, and 5.1 of Volume I. The <br />information contained in these sections is sufficient for the <br />Division to predict worst case scenarios for mining and reclamation <br />related impacts on surface water conditions of the permit, <br />adjacent, and general areas of the mine. <br />B. Sedimentation Ponds <br />All runoff from the disturbed area will be routed through one <br />sediment pond. The sediment pond is designed to contain the runoff <br />from a 10-year 24-hour runoff event. The sediment pond (Pond A) is <br />also designed to contain one year of accumulated sediment. <br />Sediment Pond 0. is designed with an emergency spillway capable of <br />passing the peak flow from a 25-year 24-hour precipitation event. <br />The sediment pond is not equipped with a principal spillway or <br />dewatering device. Instead, the applicant installed a pumping <br />system to dewater the sediment pond and use the water in the <br />hydraulic mining system. The pumping system is capable of <br />dewatering the pond within 48 hours of the beginning of a 10-year <br />24-hour storm event. The pond is to be reclaimed when revegetation <br />standards are met and runoff from the reclaimed areas of the mine <br />meet effluent limitations. <br />Stipulation No. 2 required the applicant to submit new designs for <br />a division ditch allowing fora greater slope on Channel A to <br />insure flow through the channel length and to commit to appropriate <br />erosion prevention if needed. The requirement was satisfied when <br />NC EC submitted TR-01. <br />Stipulation No. 3, which requires an annual hydrologic report by <br />January 15 of each year has been satisfied during the first permit <br />term but remains partially in effect. <br />The conditions of Section B of Stipulation 3 which required point <br />sampling of slurry water, inflow monitoring, and a report of <br />consumptive use; and Section C which required quarterly monitoring <br />of field parameters of the Colorado River were deleted with the <br />Division's approval of TR-04 and, therefore, are no longer required. <br />The conditions of Stipulation No. 4, which required NC EC to <br />demonstrate that water from the Vulcan ditch was not necessary for <br />irrigation purposes prior to use in the mining operation, are no <br />longer valid, since the mine will not become active, therefore, the <br />stipulation is not required. <br />-14- <br />
