Summary of the Review Process <br />Energy Fuels Coal, Inc. applied for a partial bond release under <br />the Colorado Surface Coal Mining and Reclamation Act for <br />backfilling and grading work on exploration drill holes and <br />successful establishment of revegetation on drill pads. The mine <br />is located in Fremont County approximately six miles south of <br />Florence. The drill holes involved in this bond release are <br />located in Township 205., Range 69W., NW 1/4 Sec. 30, SW 1/4 Sec. <br />30 and Township 205., Range 70W., NE 1/4 Sec. 25, NW 1/4 Sec. 25, <br />SE 1/4 Sec. 25, NE 1/4 Sec. 26. The total disturbance area for the <br />access routes and drill sites is 11.3 acres. The operator <br />requested that 1008 of the reclamation bond for its 1985 <br />development drilling project be released (phase I, II and III) and <br />858 of the reclamation bond for its 1988 drilling project be <br />released (phase II). <br />An incomplete application for bond release was received by the <br />Division on June 1, 1992. Upon receipt of affidavit of <br />publication, the application was deemed complete on July 16, 1992. <br />The operator requested the release of $25,400.00 of the original <br />$25,400.00 bond for the 1985 drilling project and $2,250.00 of the <br />remaining $3,600.00 for the 1988 drilling project. These bonds <br />were required as performance bonds, separate from the operator's <br />coal exploration bonds, as the drilling was completed within the <br />permit area of the mine. The Division scheduled and conducted a <br />bond release inspection on August 13, 1992. <br />The site inspection was conducted in accordance with Rule <br />3.03.2(2). Representatives of the Division and Energy Fuels Coal, <br />Inc. were present. <br />Rule 3.03.2(5)(a) requires The Division to produce a decision on <br />the bond release request and to provide written notification of the <br />decision to the permittee and other interested parties within <br />thirty days of the inspection. This proposed decision is subject <br />to review by the permittee and other interested parties. The <br />Division's decision shall become final within thirty days of its <br />issuance unless a written request for an adjudicatory hearing is <br />received. <br />
