• <br />Bond No. 8087-97-47 ;2,631,945.00 <br />Bond No. 8072-05-16 20,000.00 <br />TOTAL ;2,651,945.00 <br />During the permit renewal process, reclamation costs for the maximum <br />disturbance occurring during the second permit term (1986-1991) were <br />calculated by the applicant. The initial estimate was reviewed by the <br />Division in detail, revealing certain deficiencies in the supporting <br />calculations. An outline of all deficiencies noted in the review was <br />fo nvarded to Pittsburg and Midway on August 7, 1986. The pennittee responded <br />to each of the Division's concerns on October 24, 1986 with a revised cost <br />estimate of ;6,931,486.00. The response was reviewed by the Division, <br />resulting in a bond amount of E6 ,931 ,486.00. <br />The bond estimate of ;6,931,486.00 does not include the estimated cost of <br />reclaiming the South of Shop landslide or the West Ridge landslide for which <br />Pittsburg and Midway is liable. As agreed upon in the November T9, 1987 <br />Settlement Agreement, the cost of reseeding previously mined/affected areas of <br />West Ridge were computed at ;117,354.00. Also, an indirect cost associated <br />with reseeding of E72,356.00 was added bringing the total bond estimate to <br />;7,121,196.00. <br />Pittsburg and Midway has agreed to submit for Division approval a reclamation <br />plan for the South of Shop Slide Area prior to February 15, 1988. This plan <br />will include cost estimates for reclaiming this slide area. As such, the <br />Division has agreed with Pittsburg and Midway to not include this area in the <br />performance bond required for this permit renewal application. <br />During the permit renewal process, the Division provided Pittsburg and Midway <br />with information regarding procedures far the release of performance bonds <br />covering areas which were mined and subsequently reclaimed during the first <br />permit term. As indicated in the pennittee's September 25, 1986 response, <br />Pittsburg and Midway has elected not to apply for bond release as part of the <br />permit renewal process. Therefore, bond coverage amounts applicable to all <br />areas mined during the first 5-year permit tens will be retained by the <br />Division until such time that the pennittee submits an application for bond <br />release for those areas. The amount retained is in addition to the bond <br />amount which must be submitted to cover the worst-case disturbance occurring <br />during the second 5-year permit teen as well as that amount necessary to <br />reclaim the South of Shop landslide and the West Ridge ]andslide. <br />The ;7,]21,196.00 required bond amount for the second permit term was received <br />by the Division on December 18, 1987 and was accepted on January 7, 1988. <br />The operation is in compliance with the requirements of this section. <br />-45- <br />January 13, 1988 <br />4593E <br />
