<br />Stipulation No. 13: <br />THE APPLICANT MUST SUBMIT LETTERS OF CONSENT FROM EACH OF THE SURFACE LAND <br />OWNER IN QUESTION AUTHORIZING THAT THE ROAD OVER THEIR PROPERTY IS ALLOWED TO <br />REMAIN AS CONSTRUCTED. <br />Pittsburg and Midway submitted information on August 25, 1982 to satisfy <br />Stipulations No. 11 and i2. This information, which may be found in the <br />original permit, was reviewed and found to be acceptable. Therefore, <br />Pittsburg and Midway has satisfactorily satisfied the requirements of <br />Stipulations No. 11 and 12. <br />Pittsburg and Midway had specified that three (3) roads would remain at the <br />time of mine closure: Skyline Drive, West Ridge Road, and the existing North <br />access road. It was necessary to keep Skyline Drive since it provides access <br />to the Routt County dump and to the DBRGW communication facilities. The North <br />access and West Ridge Roads were necessary to provide all-weather access from <br />the Routt County road system to land within the permit boundary. To allow for <br />these roads to remain after Edna Mine closure, the letters as referenced in <br />Stipulation No. 13 were required. <br />Pittsburg and Midway has submitted the required letters; therefore, this <br />stipulation has been satisfied. <br />The haul road drainage system was reviewed. All roadside ditches and culverts <br />have been adequately sized to pass the design flows. <br />Along selected segments of the haul road in the Moffat Area the spacing of <br />culverts was not in compliance with Rule 4.03.1 (4 )(e)(vi). A variance has <br />been granted based on the following findings: <br />A. Culverts were located in areas of preferred or existing drainage, <br />B. Stable road embankments were designed, <br />C. Road grades were not excessive, and <br />D. All haul roads are contained within a sediment control system. <br />The operation is in compliance with the requirements of this section. <br />XXI. Bonding -Rule 2,05.4(2)(b), and Rule 3 <br />Information pertaining to performance bonding and reclamation cost estimates <br />for the Edna Mine is presented in Volume 12, Section 4.8 of the original <br />permit and in Volume 3, Section 4.8 of the permit renewal application. <br />A review of the Division's bond file for the Edna Mine indicates that the <br />following corporate surety bonds are currently in effect for operations <br />conducted prior to and during the first 5 year permit term: <br />-44- <br />
