Release. A reduction in the required bond to $95,612 is warranted. Phase I and Phase II reclamation <br />work yet to be accomplished on this permit consists of demolition and disposal of the Stoney Road <br />bridge. Additional reclamation tasks include demolition and disposal of four water monitoring flume <br />bases, reclamation of two water monitoring wells, cleaning of permanent ponds, and reseeding of <br />reclaimed areas. A copy of this Proposed Decision and Findings of Compliance document will be on <br />file for public inspection at the offices of the Division incompliance with Rule 3.03.2(2). <br />IV. PROPOSED DECISION <br />Based on this Findings of Compliance, the Division proposes [o approve, as of November 9, 2001, <br />the Minrec, Inc. Application for Partial Bond Release (SL-04) of 2001. All requirements of the Rules <br />and Act have been successfully completed. <br />A copy of this Proposed Decision to release Minrec, Inc. for liability for reclamation work as <br />described in the SL-04 Application and this supporting Findings of Compliance is being provided 66 <br />to Minrec, Inc. (permittee), the U.S. Bank N. A., the Garfield and Pitkin County Commissioners, the <br />Office of Surface Mining, Ken[ Wellner (USFS), Bruce Fowler (BLM), Janet Buck (Town of <br />Carbondale), Crystal River Ranch, and J. Burtazd (upstream landowner). Concurrently, the Division is <br />publishing written notice of its proposed decision once a week for two consecutive weeks in the <br />Glenwood Springs Post Independent, a newspaper of general circulation in the locality of the surface <br />coal mining operationb~. The Division completed its evaluation of the Application on November 13, <br />2001. These notifications advise the above agencies and persons of their right to request a public <br />heazing by December 13, 2001 [within thirty (30) days after the date of completed evaluation], or <br />within 30 days after the first publication in the Glenwood Springs Post Independent68, whichever is <br />later. The Division will also publish its proposed decision in its monthly mailing under Rule <br />1.03.2(2). <br />If no request for an adjudicatory heazing is received within the time periods provided, the proposed <br />decision of the Division shall be final69.
