EFCI submitted an application for a well permit for the "north
dewatering well" to the State Engineer's office on June 26, 1991.
The stipulation was terminated on July 3, 1991. During the fall of
1991, EFCI was informed that the application was denied. During
Mid-term review in 1992-1993, this issue resurfaced and was handled
with another stipulation, Stipulation No. 20, which reads:
THE MINE OPERATOR WILL SUBMIT TO THE DIVISION BY JANUARY 31,
1994 A COPY OF THE PERMIT APPLICATION TO THE STATE ENGINEER'S
OFFICE REQUESTING REVIEW OF A RENEWED APPLICATION FOR THE
NORTH DEWATERING WELL;
AND
THE OPERATOR WILL OBTAIN A PERMIT FOR THE NORTH DEWATERING
WELL FROM THE STATE ENGINEER'S OFFICE BY MAY 30, 1994, WHICH
WILL INCLUDE APPROVAL BY THE TWO OWNERS OF THE WELLS WITHIN
600 FEET OF THE NORTH DEWATERING WELL FOR CONTINUED PUMPING OF
WATER, AND AN EVAPORATIVE LOSS AUGMENTATION PLAN TO BE
APPROVED BY THE STATE ENGINEER'S OFFICE,
OR
AS AN ALTERNATIVE TO PERMIT APPLICATION AND APPROVAL, THE
OPERATOR WILL, BY JANUARY 31, 1994, COMMIT TO CLOSED-LOOP
RETURN OF MINE DEWATERING FLOWS TO UNDERGROUND WORKINGS,
ELIMINATING EVAPORATIVE LOSSES AND PROVIDING FOR DIRECT
RECHARGE TO THE GROUNDWATER SYSTEM.
In a faxed response, dated January 31, 1994, EFCI informed the
Division of the intent to pursue option one, and that they had
"reopened the file" with the State Engineer's Office. The Division
was informed on May 23, 1994 that EFCI wished to pursue the second
option of a closed-loop system in lieu of obtaining a permit for
dewatering. The State Engineer's Office concurred with this
decision in a letter dated June 8, 1994 addressed to the Division.
EFCI submitted Technical Revision No.19, received by the Division
on June 16, 1994. TR19 outlines the plans to close the North
Dewatering Well and channel the water into old abandoned workings,
and is currently under adequacy review by the Division.
STIPULATION NO. 14
PEAK FLOW SHALL BE MEASURED IN MAGPIE CREEK ON A QUARTERLY BASIS AT
THE CURRENT MONITORING STATION. DATA ACQUIRED FROM THIS MONITORING
SHALL BE SUBMITTED QUARTERLY AND INCLUDED IN THE ANNUAL HYDROLOGY
REPORTS FOR THE MINE.
Status - On-gOlnq
The 1991 AHR indicates that there was no water in Magpie Creek on
six sampling dates in six quarters following the issuance of the
Permit Revision.
