Summary of Stipulations <br />JSTIPULATION NO. 1 <br />THE OPERATOR SHALL SUBMIT RIGHT OF ENTRY INFORMATION FOR THE <br />FLORENCE CITY, A.T. MASSEY, AND CORLEY PROPERTIES, WHERE SUBSIDENCE <br />IS PROPOSED, 30 DAYS PRIOR TO AFFECTING THESE LANDS. <br />Status - Terminated <br />This stipulation was terminated with the issuance of the decision <br />for Permit Revision 1, March 11, 1991. Stipulation 12 was issued <br />at that time to cover additional required right of entry <br />information. <br />/STIPULATION NO. 2 <br />THE OPERATOR SHALL CONTINUE ALL HYDROLOGIC MONITORING OUTLINED IN <br />THE APPLICATION AND THIS FINDINGS DOCUMENT UNTIL SUCH TIME AS THE <br />DIVISION APPROVES OF MODIFICATION OR CANCELLATION OF THE PROGRAM. <br />Status - Terminated <br />The revised permit application, submitted in conjunction with the <br />permit renewal and approved 11/27/89, included a hydrologic <br />monitoring plan as Exhibit 25. <br />/STIPULATION NO. 3 <br />WITHIN 180 DAYS OF PERMIT ISSUANCE THE OPERATOR SHALL PROVIDE <br />DOCUMENTATION THAT THE APPROPRIATE FILINGS HAVE BEEN MADE WITH THE <br />STATE ENGINEER'S OFFICE OR APPLICABLE WATER COURT REGARDING THE <br />STORAGE AND CONSUMPTIVE USE OF WATER AT THE MINE. <br />Status - Terminated <br />This stipulation was reviewed during Permit Renewal O1, and was <br />replaced with Stipulation 13, November 27, 1989. <br />~ STIPULATION NO. 4 <br />WITH RESPECT TO THAT PORTION OF THE COAL LOAD-OUT LOCATED WEST OF <br />THE COUNTY ROAD 79 IDENTIFIED AS AN ALLUVIAL VALLEY FLOOR, WITHIN <br />TWO YEARS AFTER THE COMMENCEMENT OF THE PERIOD OF EXTENDED <br />LIABILITY AS SPECIFIED IN RULE 4.15.7(5) THE OPERATOR SHALL COMPARE <br />THE SOIL CHARACTERISTICS OF THE RECLAIMED AREA WITH AN ADJACENT <br />UNDISTURBED AREA. THIS COMPARISON SHALL BE SUFFICIENT TO VERIFY <br />THAT THE INFILTRATION, PERMEABILITY, AND TEXTURAL CHARACTERISTICS <br />OF THE RECLAIMED SOILS HAVE BEEN RE-ESTABLISHED SUFFICIENTLY TO <br />RENDER THE AREA AS POTENTIALLY FLOOD IRRIGABLE. <br />2 <br />
