2004 Midterm Review <br />operations were initiated in 1994. Facilities were demolished, backfill and grading activities were <br />accomplished, topsoil was replaced, and reclaimed azeas seeded in 1994 (PAP page 4-54). No <br />earth or revegetation reclamation work has been accomplished since the permit renewal of <br />February 28, 1997. Remaining work requirements consist of reclamation of sediment control <br />structures and establishment of required vegetation. <br />There have been no notices of violations issued against Permit C-85-065 since the fourth permit <br />renewal of October 9, 2001. <br />Section R -Revisions Since October 9.2001 <br />Minor Revision (MR) -18, decision date November 13, 2001. Update of water depletion <br />allowance. <br />Succession of Operator (SO) 02, decision date Mazch 22, 2002. Operator changed from NCIG <br />Financial to C.B. Minerals Company, LLC. <br />MR-19, decision date May 6, 2002. Incorporated access and surface agreements into the permit. <br />MR-2Q decision date January 10, 2003. Incorporation of the Colorado Department of Public <br />Health and Environment permit into the mining permit. <br />Section III -Status of Stipulations <br />There aze no unabated stipulations that were issued before, and no stipulations that have been <br />placed since, on the permit approved October 9, 2001. <br />Section N -Permit Variances <br />There aze no variances to the permit under Rules 2.06.2(10), 2.06.3(4), 2.06.5(3), and 2.06.7(5). <br />Section V -Decision to Require Revisions or Additional Information <br />The applicant is asked to more clearly demonstrate that access is authorized for continued <br />reclamation operations at the site by adding Section lines and Township and Range information <br />to Figure 4.7-4 (see Rule 2.03.6 below). The applicant is asked to describe the proposed disposal <br />of structural elements of Sedimentation Pond A in the reclamation plan [see Rules 2.05.3(9), <br />2.05.4(1), and 4.11.4 below]. The applicant is asked to reinstate Table 4.4-4, the initial cost <br />estimate, in the PAP [see Rule 2.u5.4(2) below]. <br />Findings of this review aze summarized by Rule as follows. <br />Rule 2.03.1 Objective <br />The Permit meets the objectives of the Rules. <br />
