<br />Regarding the investigation on the oil spill at the asphalt plant, the Division is satisfied with <br />Elam's explanation that the material is Liquid Asphalt Cement (AC-10). This is based on the <br />location of the spill material in relation to the asphalt plant and my conversation with the <br />operator during the inspection. Please inform the Division as to the clean-up measures that have <br />been conducted to date. <br />Elam also included two maps to be inserted into the file titled, Operations Plan Map and <br />Reclamation Plan Map. The reclamation plan map shows that the pit will be reclaimed to a <br />1.Sh:ly slope. Please note that the current reclamation plan calls for slopes to be reclaimed to <br />3h:ly. The Division cannot approve the revised maps because they show a change in the mining <br />and reclamation plan and must be filed as a technical revision or amendment to the permit (Rules <br />l.l(6) and 1.1(49). If Elam wishes to revise the reclamation plan from 3h:ly to 1 %zh; lv slopes <br />the following minimum requirements need to be met; <br />1. submit the maps in the form of a technical revision or amendment to the permit, <br />2. meet the general requirements for exhibits- Rules 6.2, 6.4.3 and 6.4.6, and <br />3. provide a geotechnical evaluation to assure that the 1.Sh:ly slopes are stable and do not <br />impact Woody Creek, Colorado-Ute Electric Association and D&RGW Rail Road (Rule <br />6.5). -The stability analysis will need to take into account the maximum depth of the pit <br />and intersection with the ground water table. <br />Until a revision or amendment is approved by the Division, the final slopes must be no steeper <br />than 3h:ly.
