Lone <br />Division Dire<mr <br />In your letter you state that a revision will not be submitted because a technical revision was <br />approved by the Division in 1992 that addresses the operations and reclamation plan. According <br />to our files, Technical Revision 001 was approved by the Division, but it only addresses <br />relocation of a road, establishment of an employee housing azea and the designation of a 40-acre <br />area within the permit area that would not be disturbed by mining. The 1992 technical revision <br />does not address the issues noted on the Division's inspection report dated August 8, 1998, <br />specifically updating the mining and reclamation plan for a larger pit area (nearly 60 acres in <br />size), the concrete plant, evaporation pond and pit dewatering activities. The Division will need <br />to conduct another site inspection to assure that the $105,000.00 reclamation bond is adequate. I <br />will contact you at a later date to arrange a date and time for a site inspection. <br />Not addressed by Elam's submittal was the matter of a concrete batch plant and any associated <br />environmental controls within the permit area. A file review indicates that the batch plant and <br />any associated environmental controls are not included in the permit application. Therefore, <br />Elam has the choice of either submitting a revisions to the permit that includes all aspects of the <br />batch plant, or removing the batch plant from the permit area within 60 days of receipt of this <br />letter. If the revision option is chosen, the revision must be submitted by January 31, 1999 and <br />completed (including posing of additional financial warranty, if required) by March 15, 1999. <br />During our phone conversation today, you mentioned that additional fill material from off site <br />would be used to reclaim the pit. Please be aware that Elam needs to meet the performance <br />requirements of Rule 3.1.5(9) prior to reclaiming the pit with fill generated from outside the <br />permit area. Elam Construction will need to incorporate this plan in the technical revision, or a <br />separate technical revision prior to reclamation of the pit. A copy of the Rule is enclosed. <br />
