Protection continues for the Foidel Canyon School, <br />a National Register site that lies near the main facilities <br />area for the mine. <br />B~ause of its location in a sandstone cliff face, site <br />SRT345 appears to be in jeopardy of being impacted by <br />failure of the cliff face caused by mining activities. <br />Also, the Bureau of Land Management (BLM) in their leasing <br />decision document felt that the Shoshone and Ute tribes <br />should be contacted to see if they have concerns about the <br />site and associated rock art. The State RA in their <br />permitting document has followed up on the BLM's concern <br />and has placed a stipulation on their permit. Permit <br />Stipulation No. 33 reads, <br />"Twentymile Coal Company will resolve all concerns of <br />the BLM and native American Indians related to the <br />rock art site 5RT345 prior to longwall undermining of <br />the site. This will include considerations of the site <br />as a Native American religious site. The mitigative <br />measures may range from photodocumentation only to <br />limited coal extraction to protect the site from <br />subsidence damage. All surveys and information will be <br />submitted to the Division as part of the confidential <br />appendix". <br />• Based on present information, it does not appear that site <br />5RT32 will be impacted by subsidence. However, the BLM has <br />proposed a lease stipulation that reads, <br />"If surface disturbance is proposed or becomes likely <br />at archaeological site 5RT32, mitigative excavation of <br />the site will be required. The lessee must submit a <br />mitigation plan to the Authorized Officer for review <br />and approval". <br />The State RA is also requiring the company to conduct <br />additional archaeological inventory. Under Stipulation No. <br />34, <br />"Twentymile Coal Company will complete archaeological <br />and cultural resource surveys of all areas to be <br />affected by surface disturbance or subsidence within <br />the new permit areas added by PR-02 (Southwest Mining <br />District). This information will be gathered and <br />submitted to the Division 60 days prior to mining in <br />Panels 7,8, or 9 of the Southwest Mining District". <br />In that no surface disturbance is anticipated from the <br />expansion of underground mining into new Federal coal, and <br />• in consideration of the lease and permit stipulations, a <br />finding of "no adverse effect" for the mining expansion is <br />2 <br />
