The Fish and Wildlife Service (Service) concluded in the May 11 <br />memorandum that enough information did not exist to concur with the Office <br />of Surface Mining's "no affect" conclusion for the federally listed fish <br />species. The letter requested additional information regarding water use. <br />Twentymile Coal Company has provided additional information to Service <br />hydrologists in our Denver Regional office. Based on the evaluation by <br />Service hydrologists, the Service now agrees that a depletion from the <br />upper Colorado River basin is highly unlikely for the proposed Foidel Creek <br />Mine expansion. .Consequently, the Service concurs with OSM's "no affect" <br />conclusion for this activity. Further consultation under authority of the <br />Endangered Species Act is not required for this action unless the project <br />is modified, new species become federally listed that may occur in the <br />area, or new information reveals effects of the action not previously <br />considered. <br />We appreciate your attention to the potential impacts to the federally <br />listed fishes.
