Nettleton <br />RECEIVED <br />oEC o ~ ~ss~ <br />pivieion of Minerals & Ggology <br />Subject: Oxbow Mining, Inc. -Field Modifications <br />Bill - As 1 noted in our recent phone conversation, the ongoing mine expansion activities <br />represent a dynamic process with minor changes in the location acid/or configuration of facilities <br />occurring as necessary to best fit the terrain and existing site conditions a~td constraints. It <br />should be noted that any proposed changes involve joint review by Oxbow personnel and <br />contractors and represent enhancements over original layouts relative to reductions in disturbance <br />and impacts or design improvements. It is Oxbow's intent to incorporate all changes in the <br />permit. as appropriate, recognizing that some changes may be more significant than others from a <br />regulatory and compliance perspective. <br />In order to incorporate all minor modifications into the permit in the most reasonable and <br />straightforward manner, Oxbow proposes to prepare and submit a "housekeeping" revision <br />reflecting as-built conditions on completion of the current expansion activities (covered by TR- <br />29 and MR's 42, 43, and 45). We recognize that certain modifications may, however, be <br />significant enough to warrant separate revisions. In order to keep you apprised of anticipated <br />changes and to provide a basis for identification of any modifications that may require a separate <br />revision I will periodically provide a list and description of any changes for your information and <br />review. The following lists and briefly describes those changes identified to date and references <br />the associated permit revision: <br />1) Topsoil handling for West Valley Diversion (TR-29) - In order to establish drainage <br />control prior to site disturbance it will be necessary to construct the West Valley <br />Diversion before effective access from this area had been established to the Elk Creek <br />soil stockpile. Preliminary site work indicates [hat soils in the upper portion of the <br />West Valley drainage are very rocky and probably unsalvageable, however, soils on <br />[he staked diversion alignment on the ridgeline to the west appear to be of good quality <br />and will be salvaged (refer to soils discussion in Section 2.04.9 and Appendix H of the <br />permit document).
