As discussed during our meeting of February 27, 1981, I am forwarding the
results of the initial technical environmental assessment of the Deserado
Mine permit application. This assessment is the product of a joint approach
between this office and the office of Surface Mining in an effort to eliminate
duplication during the review process.
The comments contained in this letter reflect the nature of the written
determination required of the Division and the Office of Surface Mining prior
to issuance of a permit. For numerous portions of the application, additional
information is necessary before a complete technical review and resultant
regulatory determination can be finalized. In other instances, clarification
may be requested. If you have any questions regarding any of the requests,
we will be glad to meet with Western Fuels representatives for further
discussion.
The summary attached to this letter has been reviewed according to the
requirements of the "Regulations of the Colorado Mined Land Reclamation Board
for Coal Mining" and organized to follow the format of Rule 2 of the referenced
regulations, which contains the requirement for a permit application. You
will also find cross - references throughout the summary to the performance
standards in Rule 4. Page numbers from the application have been referenced
as necessary to enhance clarity.
It should be noted that the attached summary does not reflect a review of
the subsidence or alluvial valley information submitted by Western Fuels
during the meeting of February 27, 1981. In the interest of forwarding
this material to you in an expeditious fashion, the new information was
riot analyzed. The attached summary in combination with the discussion of this
new material during the meeting of February 27, 1981 should enable Western
Fuels to evaluate whether or not the information addresses the concerns of
this summary.
