Lamm <br />Governor <br />DATE: May 1, 1984 <br />T0: Fred Banta ~ <br />i <br />FROM: Dan Mathews ~ <br />RE: Western Slope Carbo Crystal Meadows Fill - File No. C-016-81 <br />III IIIIIIIIIIiII III <br />999 <br />At your request, I have researched the old WSC files and come up with the <br />attached summary sheet on the History of the Crystal Meadows dump site. <br />Originally, I did not think that the site was actually permitted, but my <br />latest file search uncovered an untitled document (attached) which contains <br />the final reclamation plan for the refuse dump along with reclamation plan <br />information for other mine areas. Both permit 78-155 and the Crystal Meadows <br />plan submitted in response to the NOV/C&D order were approved by the Board at <br />the November, 1978 meeting. <br />I have not been able to find my notes taken from the recording of that <br />meeting, but one of us should probably listen to it again. It was my original <br />impression that the permit approval and the Crystal Meadows plan were treated <br />as separate issues. <br />There were no revegetation success standards established - none were required <br />at that time. The hydrology monitoring period was indefinite. <br />Crystal Meadows History <br />1. Inspection Report by R. Overton and D. Massey of the Division dated July <br />6, 1978 documented unapproved dumping of coal waste at Crystal Meadows. <br />Recommended cessation of dumping and removal of waste. <br />2. Follow up inspection July 20, 1978 by Tom Ehmett, OSM. <br />3. NOV and C&D order issued by MLRB August 1, 1978. Order required WSC to <br />"submit a plan for refuse disposal" and specified that the plan "include [a <br />proposal] to rectify the environmental damage that has occurred since July 1, <br />1976 at the Crystal Meadows site". <br />4. WSC submitted a plan in a letter dated August 22, 1978 which contained 3 <br />alternatives. Alternative 2 was a compromise and was what the Division <br />recommended the Board approve, with modifications. Alternative No. 2 called <br />for reclamation of the refuse on site and included a general plan for <br />compaction, topsoiling, riprapping the outslope and reseeding.
