These findings are~hased on information <br />made available to the Division that demonstrates that the applicant <br />will be able to operate in compliance with the Colorado Surface Coal <br />t4ining Reclamation Act and the regulations promulgated pursuant to the <br />Act. <br />This findings documn_nt .is organized according to the major disciplines <br />reviewed during tLe permi.ttiny process. The written findings which <br />must be made by 'the Division are addressed tu:rler the appropriate <br />discipline subtitle. For example, findings concerning fire protection' <br />of endangered or threatened fish and s~Jildli.`e snocics :rill be found <br />undez the subtitle of 1°i sh and !^Lil dli fe. 1,1so, anu specific approvals <br />required to he made by the Division pursuant to Ruin •2 and thus requiring <br />a written finding pursuant to Rule 2.07.6(2)(m) arc discussed under tiro <br />appropriate discipline subtitle. <br />I. Legal, Financial and Compliance Information - P.u1e 2.03 <br />Colowyo 7cquested c;.ithin the application that a life-of-nine permit term <br />be granted. The Division has not granted a variance from the standard <br />five-year permit term in this instance. Since Colowyo was not able to <br />provide the specific financial justifi.cati.ons as required by Section 3,- <br />33-209(5) of the Colorado Surface Coal Mining Reclamation Act- and Pule 2.01.5 <br />of the Colorado Regulations. The 5,550 acre area designated .in the permit <br />application as the "permit area"-is considered bu the Division to represent <br />the "life-of-mine-area". The Division is approv.iny only those existing <br />and proposed surface fa r_iliti es in T4 hl, P.03GT anr7 T3N, R^3~9 and parts of <br />Sections 2, 3, S0, and 11 of T3i~, R93t9, which 1i~~ within the five-year <br />bond boundary as delineated On Map 34 of the pc•rn+.i. t: app.lica t-.i.on. <br />Though flee applicant- was not able to meet all of the requirements for a <br />permit term of longer than five-years, the applicatiien was prepared to <br />be effective for the life-of-the-mine.
