Summary of Permit and Operation <br />The Review Process <br />The Apex No. 2 Mine, operated by Sunland Mininc Corporation, is located in Routt County <br />approximately 6.~ miles northwest of the [own of Oak Creek along Routt County Road 29. The <br />mine has been operated by Sunland Mining Corp. since 1976. <br />The original permanent program permit application was submitted by Sunland Mining Corp. on <br />February 4, 1981. The Division proposed to approve this application as detailed in the proposed <br />decision and findings of compliance document (fated March, 1933. "this decision to approve <br />became final and Permit C-81-O11 was issued to Sunland Mining Corp. on ivlay 26, 1983 for a <br />five-year term. <br />The Apex No. 2 Mine temporarily ceased operations January 26, 1936. On IVlay 16, 1988 the <br />Division issued a proposed decision to approve the renewal of the original permit (permit <br />renewal No. 1) and this became final after the 30 day public comment period without comment. <br />As required by Rule 2.08.5(2)(a), the Division sent notice to Sunland Mining Corp. on August 3, <br />1992 pertaining to the forthcoming expiration of Permit C-81-O11 on May 26, 1993 and the right <br />of successive renewal. Sunland Mining Corp. submitted Permit Renewal No. 2 application which <br />was received by the Division on November 30, 1992 (prior to the 180-day filing deadline). This <br />application was deemed complete on December l0, 1992. The Division forwarded adequacy <br />letters to Sunland Mining Corp. on February 8, 1992. Sunland's responses to those letters were <br />adequate and the Division issued a proposed decision to approve the renewal on May 7, 1993. <br />The approval became final after the 30 day public comment period passed without comment. <br />The current permit revision process began with the Division notifying Sunland Mining Corp. in a <br />letter dated August 25, 1997 that Sunland's permit would expire on May 26, 1998, and that in <br />order to ensure the successive right to renewal, a complete application for permit renewal must <br />be received by the Division by November 27, 1997. The Division received the RN-03 <br />application from Sunland on November 26, 1997, but the cancellation notification process <br />specified on the liability insurance certificate was inadequate thus rendering the renewal <br />application incomplete. The operator's agent was immediately notified of this deficiency via a <br />fax memo on November 26, 1997. The Division then notified Sunland in a letter dated December <br />8, 1997 that the application was incomplete. The Division received a corrected certificate on <br />January 20, 1998, and found the renewal application complete on January 21, 1997, beyond the <br />180-day deadline for securing the successive right to renewal. The application was for another ~- <br />year term and called for the continuation of reclamation operations. The Division sent <br />preliminary adequacy review questions to Sunland on March 17, 1997; responses were received <br />from Sunland (via fax) on April 2, 1998. There were a few more exchanges of comments and <br />responses before the Division found the renewal application adequate on April 8, 1998 and <br />issued the proposed decision to approve the application on April 17, 1998. <br />Apex No. 2 Mine, C-81-O1 I 3 Amended December 2I, 1998 <br />
