additional land disturbance. All disturbed runoff at the Apex No. 2 Nline is routed <br />through a sedimentation pond or otherwise controlled to minimize deleterious effects of <br />mining on the water quality of Trout Creek. In addition, Sunland Mining has conunitted <br />to three measures in order to minimize impacts to wildlife resources: <br />1. Limiting activity during the sensitive deer and elk wintering period; <br />2. Prohibiting the use of persistent pesticides; and <br />3. Prohibiting the discharge of firearms by employees. <br />No electric transmission lines exist or are proposed to be constructed which pose a threat <br />to raptors.l (4.18(4)(8)). <br />XIV. Protection of Underground Mining <br />The Apex No. 2 Mine operated adjacent to the abandoned Apex No.l mine and utilized <br />the Apex No.l portal for ventilation. This practice was started prior to the implementation <br />of these regulations (4.19(1) and 4.22.4(1)). <br />XV. Subsidence Control <br />Sunland Mining Corp. hired a consulting firm to develop a subsidence control plan for <br />the mine. The only resource identified in the permit azea requiring protection is a <br />seasonally occupied ranch house located in Fault Block No. 3. Sunland Mining Corp. had <br />committed in the original permit application to subsidence monitoring and a reduction in <br />coal recovery in this fault block as measures to protect this ranch house. As part of Permit <br />Renewal No. 1 application, Sunland Mining Corp. has dropped consideration of mining <br />in this fault block. Based on hydrologic investigations and the nature of the geology, the <br />Division has concluded that any subsidence above the planned mined area will have <br />negligible, if any, impact on the ground water regime. Information pertaining to <br />subsidence is presented on pages 139-190 and 194-211. <br />XVI. Concurrent Surface and Underground Mining <br />At the Apex No. 2 mine, mining was not conducted concurrently with surface mining, <br />therefore, specific findings for this section are not required (4.22.2). <br />XVII.
