13. Sunland Mining Corp. proposes to return the area to its original land use of rangeland and
wildlife habitat with the exception of Routt County Road 29. Based upon a request from
Sunland, the Division assisted in developing the seed mixture presented on page 184 of
the permit application. This seed mixture was used during foal reclamation of this mine
site and does not have any shrub species. The landowner has requested that no shrubs be
planted to allow for more erowth of desirable grass and forb species for grazing purposes.
Due to the limited areal extent of the area to be reclaimed and the wooded nature of
adjacent areas, the Division has agreed to this request.
Along with developing the revegetation plan, Sunland Mining Corp. also requested
assistance in developing the revegetation success criteria. Because of no true baseline
data from the Apex No. 2 Mine, the revegetation success criteria were developed by
averaging premining data from adjacent mines taking into consideration the limitations of
this site. The approved success standards are presented on page 184.1 of the permit
application.
14. Specific approvals have been granted and are proposed. These approvals are addressed in
the following section, Section B. (2.07.6(2)(m)).
15. The Division finds that the activities proposed by the applicant would not affect the
continued existence of endangered or threatened species or result in the destruction or
adverse modification of their critical habitats. (2.07.6(2)(n)).
16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As
of this time, May 3, 1993 the operator is current in the payment of reclamation fees
required by 30 CFR Chapter VII, subchapter R. (2.07.6(2)(0)).
Apex No. 2 Mine, C-S I-01 I 12 Amended December 21, 1998
