County Commissioners <br />Bouldar County, Co, <br />Page -2- July b, 1973 <br />(e) Sackslopes of the excavation have been flattened from 2' horizontal <br />by 1' vertical to 3':1'. <br />(f) Irrigation ditch carrying the South Branch of St. Vrain Creek, Goss <br />No. 1 and Goss No. 2 and the Clough and True water is to be lined with <br />concrete to prevent loss of woter by seapage. This clteration pcrrr,itted <br />a change in design of the ditch as indicated. (Also see letter from <br />W.W. Wheeler 8 Associates, Par. 6 below), <br />(g) A railroad spur has been added to permit the lording of railroad cars <br />near the point where the B-N track crosses our east ,oroperty line. <br />(h) Our sequence of operations or excavating has been completely revised <br />to permit us to stockpile gravel with less obstruction to the overflow chcnnef <br />of the St. Vrain. <br />It may be well to note at this point that no great amount of stockpiled <br />material will ever be in the overflow channel. !t will be loaded out cs fast <br />as it is dug, except that it will be necessary to retain some 30, OCO tons for <br />draining prior to loading. Such retained stockpiles wilt be place] along <br />side the excavation. <br />_ (3) A pennit from the Division of Highwcys, State of Colorado, for a driveway approach <br />on the right-of-way of State Highway 66. <br />(4) We have agreed to a changing in the performance bond from $25,000 t;~ $30,000. <br />However, the bonding company will not supply the bond until they see the terms of our <br />permit. At the time you send us the permit for our signature, we would cppreciate <br />three extra copies to be forwarded to our bonding agent. We will then retLrn the bond <br />with the copies we have signed. <br />(5) One copy of a Certificate of Insurance from Commercial Union Compenies in the <br />amountsof 5100,000/$500,000, General Liability & Automobile Liability for bodily <br />injury and property damage, with a $2,000,000 umbrellc liability. <br />One copy of Certificate of Insurance certifying coverage with the Stag: Compensa- <br />tion Insurance Fund. <br />(b) Three copies of letter from W.W. Wheeler 8, Associates, Consulting Er.cineers, <br />` dealing with the problem of our operations dewatering surrounding orooertios, the:.:~y <br />creating possible damage to wells and~or trees, etc. We agree to abide by •he te;^.s <br />- of this letter. This letter also calls attention to the concrete ditch lining (2~,f) cbovo). <br />
