s <br />Because of numerous concerns by the Division over surface hydrology and groundwater issues, <br />CCMC modified their proposed mine plan and submitted a "dry mine" plan in December 1982. This <br />plan was approved by the Division as described in the June 16, 1983 Findings of Compliance. A <br />mining permit for coal was issued to Colorado Coal Mining Company for the Colorado Coal Mine <br />No. 1 on March 1 2, 1984. The mining allowed by this permit, however, never occurred. <br />On February 22, 1985, the Director of the Department of Natural Resources was notified by Perma <br />Resources of the acquisition of Kaiser Steel Corporation and the proposed transfer of Perma's <br />subsidiary, Colorado Coal Mining Company, to Kaiser Steel Corporation. Information subsequently <br />provided indicates this transfer took place on March 28, 1985. <br />During the summer of 1986, the Division conducted a midterm review of the permit. In response <br />to the Division's midterm adequacy comments, Kaiser Steel Corporation, having assumed the obliga- <br />tions of the Colorado Coal Mining Company, responded by submitting two sets of reorganized and <br />revised permit documents on December 24, 1986. <br />In accordance with Rule 2.08.5, the Division notified Colorado Coal Mining Company of the need <br />to renew the existing permit on June 3, 1988. The application was received on November 15, <br />1988, and was approved on August 22, 1989. <br />On January 26, 1989, a technical revision (TR-09) was approved which revised the mine's reclama- <br />tion plan for the property. <br />On June 1, 1989, a technical revision (TR-10) was approved which suspended hydrologic <br />monitoring at the site. <br />On March 8, 1990, a technical revision (TR-1 1) was approved that added a sediment control pond. <br />On July 30, 1990, Kaiser Steel Resources applied for a Phase I Bond Release, requesting a reduc- <br />tion inthe then-posted 5250,000.00 performance warranty to a new amount of S 100,000.00. The <br />application was deemed complete upon receipt of the proof of publication of public notice on <br />October 1, 1990. The Division scheduled and conducted a bond release inspection on October 19, <br />1990. The request was subsequently approved on December 31, 1990. <br />On January 22, 1992, a technical revision (TR-121 was approved that removed sedimentation <br />control ponds A and B. <br />On November 9, 1992, Kaiser Steel Resources applied for a Phase II Bond Release, requesting a <br />reduction in the then-posted S 100,000.00 performance warranty to a new amount of 537,500.00. <br />The application was found incomplete on November 24, 1992. <br />On April 22, 1993, Kaiser Steel Resources submitted an. application for a permit revision (PR-01) <br />to reduce the permit area and consolidate the permit documents. On June 3, 1993, Kaiser Steel <br />Resources became Kaiser Resources, Inc., and requested this name change be reflected in the <br />permit revision application. <br />On June 25, 1993 and August 25, 1993, Kaiser Resources submitted additional information pertain- <br />ing to the Phase II Bond Release found incomplete on November 24, 1992.
