Page 2 • <br />RE: USR - SIEGRIST <br /> <br />a. The proposal is consistent with the Comprehensive <br />Plan policies which allow uses of an industrial <br />nature to occur where the resources are avail- <br />able (i.e. gravel resources as identified on <br />pages 62-63 of the Plan). <br />b. The proposal is consistent with the intent of the <br />Agricultural Zone District in that the proposed use <br />does not interfere with other agricultural <br />activities in the area or the County and as a use <br />by special review can take place in the district. <br />c. The activities proposed will be compatible with <br />existing agricultural uses in the area. The <br />intended proposal will not have significant traffic <br />or noise impacts, nor will it require significant <br />improvements which might create incompatibility. <br />d. Use by Special Review Operations and Design <br />Standards provide adequate protection of health, <br />safety and welfare of the neighborhood and County. <br />e. The Overlay District affecting the site Flood <br />Hazard District, has been addressed in the <br />attached standards for the operation. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners that the application for a Use by Special <br />Review for the site application of a Gravel Mining Reclamation <br />on the hereinabove described tract of land be, and hereby is, <br />granted subject to the following conditions: <br />1. The attached standards for use by special review be <br />adopted. <br />2. The following note being placed on the Use by Special <br />Review Permit plat; <br />NOTE: The Mined Land Reclamation Board has the <br />authority to issue permits for mining and <br />reclamation activities. Activities related <br />to mining and reclamation are therefore under <br />the jurisdiction of the Mined Land Reclamation <br />Board; however, Weld County has jurisdiction <br />of those matters outlined in the Operations <br />Standards. <br />3. The Operations Standards being placed on the Use by <br />Special Review Permit plat. The Use by Special Review <br />plat shall be delivered to the Department of Planning <br />Services. <br />4. Prior to approval of the Use by Special Review Permit <br />by the Board of County Commissioners, the applicant <br />shall submit the following requirements: <br />a. That Robert L. Siegrist, Siegrist Construction <br />Company be required to provide dust abatement <br />measures on County Road 28. <br />b. An acceptable agreement with Last Chance Ditch <br />Company and the referenced drainage ditch that <br />it will not be adversely affected by storm runoff <br />and sedimentation generated by the gravel mining <br />operation. <br />c. Comply with Section 26.2 of the Weld County Zoning <br />
