Proposed Decision
The Colorado Division of Minerals and Geology proposes to approve, with conditions, an
application for a permit revision (Permit Revision No.1) to a valid existing permit. This decision
is based on a finding that the operations will comply with all requirements of the Colorado State
Program as found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et seq.,
and the Regulations promulgated pursuant to the Act. If no request for a formal hearing is made
within thirty (30) days of the first publication of the issuance of this proposed decision, then this
decision becomes final. The permit application, all supporting documentation and any stipulations
or conditions will become a binding part of the permit. A summary of previous and existing
stipulations is provided below. Stipulation numbers 1-12 have been complied with. Stipulations
numbers 13 and 14 are existing stipulations, and one new stipulation (Stipulation 15) has been added
with Permit Revision No. 1.
Stipulations to Permit:
STIPULATION NO. 1
PRIOR TO INITIATING MINE RELATED DISTURBANCE AT THE YOAST MINE, SENECA
COAL COMPANY MUST OBTAIN THE FOLLOWING PERMITS AND SUBMIT THEM TO
THE DMSION:
1. NPDES PERMIT- PERMIT REQUIRED PRIOR TO CONSTRUCTION OF ALL
SEDIMENT PONDS AT THE YOAAST MINE.
2. STORM WATER DISCHARGE PERMIT- PERMIT REQUIRED PRIOR TO
CONSTRUCTION OF THE HAUL ROAD AND ALL MINING ACTIVITY.
3. WATER RIGHTS AND AUGMENTATION APPROVAL- DOCUMENTATION OF
APPROVAL OF WATER RIGHTS AND AUGMENTATION PLAN FROM DISTRICT
COURT PRIOR TO CONSTRUCTION OF ALL SEDIMENT PONDS AND WATER USE
FOR MINING ACTIVITIES.
4. ROUTT COUNTY SPECIAL USE PERMIT- PERMIT REQUIRED PRIOR TO
CONSTRUCTION OF HAUL ROAD, IMPACTS TO COUNTY ROADS AND ALL
MINING RELATED ACTIVITIES.
5. AIR QUALITY PERMIT- PERMIT REQUIRED PRIOR TO CONSTRUCTION OF
HAUL ROAD AND MINING ACTIVITIES. IF AIR PERMIT IS NOT REQUIRED FOR
HAUL ROAD CONSTRUCTION, SENECA COAL COMPANY MUST SUBMIT
DOCUMENTATION OF THIS FACT.
6. FEDERAL AND STATE EXPLOSIVES PERMITS- PRIOR TO CONDUCTING
ANY BLASTING ACTIVITIES.
