Rockcastle previously <br />submitted a vegetation study conducted by IMS, Inc. to the Colorado <br />Mined Land Reclamation Division ("CMLRD"). Rockcastle feels that <br />this study indicates that revegetation has been successfully <br />reestablished at the site, particularly when considering the time <br />of the season the study was conducted and grazing of the site. <br />Rockcastle will submit a complete bond release package as required <br />by the stipulation by June 1, 1990 or as soon thereafter as as- <br />built post-mining topography maps are available. Rockcastle may <br />submit appropriate bond release requests for pits 1, 5 and 6 <br />pending review of the as-built drawings of the post-mining <br />topography. <br />BTIPIILATION 7 <br />To date Rockcastle has been unsuccessful in obtaining <br />additional finances necessary to meet the revised bond amount of <br />$572,000. Consequently, Rockcastle requests that it be given until <br />April l0, 1990 to obtain the necessary financing. <br />Rockcastle will continue to cooperate with MLRD to promptly <br />resolve remaining concerns related to the stipulations. In order <br />expedite the resolution of the remaining issues, Rockcastle <br />proposes a meeting between CMLRD and Rockcastle's representatives <br />and attorneys on either March 1 or 2, 1990.
