Dept of Natural eeaources <br />As per our discussion last week and your letter dated April 17, <br />which we received yesterday, we would offer the following <br />response to your notice of possible violations. <br />As way of background, the Henderson property and the Sandy Acres <br />property to the north were originally planned by different <br />individuals as separate gravel mining operations. Aowever,~after <br />both were approved, Seigrist Construction Company acquired title <br />to the Sandy Acres property and entered into a contract <br />to mine the Henderson property from the present owners (Spann, <br />et. al.). Thus they began to think of the mining of the two <br />properties as one continuous operation. They of course need to <br />revise the two plans to reflect this, but there was no intent to <br />purposefully violate any permit and all of the affected property <br />owners are in agreement with the mining that has been undertaken <br />to date. <br />Earlier this year Seigrist met with the owners of Apnders~n, and <br />determined that from the standpoint of mining the two properties <br />continuously, two items were desirable. First, in regard to the <br />dirt stockpiles, due to the limited size of the property, the two <br />parties agreed that Seigrist could remove the stockpiles, <br />provided the surface dirt was replaced by soil from another <br />location; specifically, from the topsoil that would be strapped <br />when the Sandy Acres mining was undertaken. Secondly, from the <br />standpoint of revenue, the Henderson owners requested Seigrist <br />remove all of the gravel from the north 25' bank area rather than <br />leave it unexcavated. The bank could then be replaced wit <br />overburden, or if jointly agreed to, just not replaced, t~s <br />making a combined larger lake after all mining had ceased on both <br />properties. The fence caving into the pit was not intended, and <br />will be immediately repaired as it does constitute a safety <br />hazard. <br />P9:MLRB..81.9 - <br />r <br />
