T <br />that Phil Kessler has liability insurance and workmans compensation <br />as specified in the invitation of bid document. I suggested <br />hauling rip-rap material off-hours, but EFCI was concerned that <br />they would not be supervised. At this time, EFCI will not give <br />their consent to haul rip-rap through their mine and across Magpie <br />Creek. Randy Acres agreed to keep this open for further <br />discussion. <br />Our options at this point look bleak, but are as follows: <br />1. Re-open the access road to the west Pit Diversion. This task <br />could be completed, but could not be reclaimed again to <br />achieve the 3:1 slope requirement specified by the AML <br />program. This would also create a stability problem for the <br />slope & possibly the road. I am unsure of the impacts this <br />would have on the Magpie Creek diversion ditch. Without <br />properly reclaiming the slope back to a 3:1 configuration, <br />additional sediments could contribute to the diversion ditch. <br />The cost to conduct this task will also increase the price for <br />the job. We are already very short on funds to use for the <br />ditch itself. Every last penny needs to go for additional <br />rip-rap. Kessler said that it could be done for additional <br />money, but could not be reclaimed in its current <br />configuration. <br />2. Access around the south end of the West Pit. Hauling trucks <br />around the south end would be quite dangerous with rip-rap <br />because of the steep grade. The grade is roughly 3:1 over <br />the hill. Kessler stated that the trucks could not make it <br />over the hill with the weight of the rip-rap material. <br />3. Access Magpie Creek above Southfield Mine. This option was <br />discussed with Randy Acres and Al Weaver of EFCI on site. <br />Haul trucks would have to go through Southfield and access <br />Magpie Creek by Newlin Creek Mine. Hauling 60-80 trucks of <br />rip-rap through Magpie Creek would create quite a bit of <br />disturbance to the drainage channel, and repairs may be <br />costly. Hauling rip-rap this far would also increase the cost <br />of the job. <br />4. Helicopter in rip-rap. Not enough money. <br />5. Try to get more money from Harrison-Western. In light of the <br />new obstacles and problems that have occurred, can we try to <br />get more money from Harrison-Western? Maybe then we can do <br />option 4 (ha ha). <br />6. Put the job on hold. Essentially this would be our last <br />option because we have no other options. We pay Kessler for <br />the time & money he has spent to date over this ditch. In <br />recent conversations with Maggie VanCleef, we can suspend this <br />project as long as we need to, even beyond a year.
