Reclamation - West Pit Diversi on Ditch <br /> Right of Entry through EFCI <br />On April 13, 1994 I spoke with Randy Acres regarding access through <br />the Southfield Mine to perform work at the West Pit. This was a <br />follow-up conversation from the meeting between DMG and EFCI on <br />March 17, 1994 on site. As you are aware, the access road to the <br />West Pit has been reclaimed by the contractor performing work at <br />the East Pit. The road was reclaimed prior to DMG and Dr. Corley <br />reaching an agreement on the proposed changes to the ditch. The <br />slope was reclaimed from the fan light-use road to roughly half of <br />the West Pit road. Photographs were taken, and are attached for <br />your review. The slope regraded was specified by AML to be 3:1. <br />It drops down to the Magpie Creek Channel. Based on the latest <br />activity, I have been pursuing other right of entry options to <br />access the West Pit. <br />Energy Fuels was contacted once the Division realized that the <br />access road leading to the West Pit was removed. The Division met <br />shortly after with Al Weaver and Randy Acres of EFCI and Phil <br />Kessler of Kessler Construction on March 17, 1994. The Division <br />proposed to enter the Southfield Mine to the yard area. From the <br />yard area, the contractor would cross Magpie Creek in a low area <br />right off the side of the yard area road. This low area was on <br />average 3 feet deep across the channel and contained very little <br />rip-rap. Roughly 30 feet of the channel would be crossed to access <br />the West Pit area. Crossing in this area would create the least <br />amount of disturbance to Magpie Creek. Randy Acres seemed very <br />concerned about the proposal and the amount of trucks that would <br />enter the property. Randy Acres stated that he would consult with <br />members of EFCI and get back to me within a few days. <br />After several weeks of unreturned phone calls, I finally spoke with <br />Randy Acres regarding access through their property. Randy <br />consulted with the Vice President of EFCI, Jim Cooper. Randy <br />stated that reclamation of the West Pit Diversion would be "no <br />benefit" to EFCI. The trucks hauling the rip rap through the mine <br />site would create additional liability for the company. I stated <br />
