Procedures and Items" <br />page 2 <br />12- Construction of Phase II Caissons and Surrounding Gravel <br />The proposed construction sequence of crushed ore and select fill placement beneath, <br />and adjacent to, the caissons appears appropriate. CC&VG is aware that the Cat <br />777's require the specified fill thickness between them and the liner at all times. The <br />sequencing is analogous to that used in the construction of the Phase I caissons. <br />Finally, the certifying professionals must, as always, be confident that the underlying <br />liner and protective fill placement has occurred properly, because the consequences <br />of later discovering a construction and/or certification inadequacy would be significant <br />after the placement of an additional 60 foot thickness of crushed ore. <br />(3) DMG's Review of the "Crescent Area" and Phase II Final Certifications <br />lal I appreciate Mr. Dillie's willingness to act as primary reviewer of the "Crescent <br />Area" certification report. As you are aware my current duties relating to the <br />Summitville/Friedland litigation consumes the majority of my professional effort. <br />I regret that it will probably continue to do so for the foreseeable future. Mr. <br />Dillie will bring any quandaries to me, if he deems it appropriate. I have every <br />confidence in Jim's ability to independently review the report. I would observe, <br />however, that while CC&VG required several months to submit the report <br />following completion of the work, the Division will attempt to review it <br />expeditiously, <br />Ib1 Mr. Hardaway informs the Division that CC&VG anticipates "a very short time <br />period for preparation and acceptance" of the final Phase II certification. Based <br />on the time period apparently required for preparation and acceptance by <br />CC&VG of the "Crescent Area" certification report, which only involved several <br />acres, I must admit to being somewhat skeptical regarding Mr. Hardaway's <br />optimism. I, of course, wish CC&VG every success in realizing Mr. Hardaway's <br />expectations. <br />Once submitted, the Division will expend every normal effort in reviewing the <br />document. Frankly, in light of the other 2300 active permits we regulate, and <br />the normal short-handed situation caused by the "end-of-year holidays", I am <br />not as optimistic as John regarding our ability to expedite the review of a <br />massive document submitted during the holiday period. Perhaps CC&VG might <br />consider partial, but final, certification data submittals, rather than the submittal <br />of a massive certification report. This should allow the Division to expedite <br />issuance of its final opinion after receipt of the final portion of the report. The <br />Division will, as usual, attempt to recognize operator's unusual needs. <br />
