Matthews: <br />RECEIVED <br />FEB 21 ~gg~ <br />Mined Land <br />Reclamation Division <br />Please find enclosed responses to the items listed in your letter of <br />February 4, 1991. <br />Compliance with County Permitting Requirements <br />Eastside Coal Company will obtain Garfield County approval prior to <br />resumption of mining operations. Copies of the approval will be <br />forwarded to P1ined Land Reclaillatiun Division upon receipt from the <br />County. <br />Removal of Rifle Luadout from the Permit Area <br />A Mining and Reclamation Permit issued by the State of Colorado in <br />compliance with the applicable rules and regulations of the Colorado <br />1~lined Land Reclamation Board does nut address the viability of an <br />operation. That decision is left up to the private company involved. <br />If the operation is not in compliance with the performance standards <br />of the CMLR Regulations and the permit issued in accordance with the <br />regulations then the nun-compliance would become an issue. Enforcement <br />action would then be required of the CMLR Division. The nun-compliance <br />would have to be corrected or the operation could face shutdown, <br />forfeiture of bond and reclamation. <br />A luaduut facility, or additional facilities associated with transporting <br />coal to the market are nut planned during the term of the present <br />permit ur during the life of the present permit. <br />Coal will be transported to the final user by trucks. Forty trucks per <br />day can haul 200,000 tuns per year operating eight hours per day, 260 <br />days per year. If a luaduut nut located in the present permit area is <br />planned fur future development, a permit will be obtained for it. <br />Eastside Coal does not have any plans to construct a power plant next <br />to the nli ne. <br />
