McLean • • Page 2 <br /> May 1, 2001 <br /> The State and Division Engineers have reviewed the plan and the adequacy of each <br /> source of water provided for use as augmentation water, including, where necessary, the <br /> historical consumptive use of each water right, and return flows from diversion of waters <br /> imported into the Arkansas River Basin or other fully consumable waters proposed for use as <br /> augmentation water. In accordance with Section 25-8-202(7), C.R.S. and Senate Bill 89-181 <br /> Rules and Regulations adopted on February 4, 1992, the State Engineer has determined that <br /> subject to the terms and conditions below, the replacement supply is of a quality to meet the <br /> requirements of use to senior appropriators. <br /> This substitute water supply plan is hereby approved pursuant to Section 37-80-120, <br /> C.R.S., subject to the following conditions: <br /> 1. The surface area of groundwater exposed within the pit shall not exceed one acre. <br /> 2. Pumping from the pit during this plan is limited to 1.75 acre-feet for dust suppression <br /> purposes. All pumping must be metered in a manner acceptable to the Division Engineer. <br /> 3. Wet aggregate production from the pit during this plan is limited to 132,000 tons. <br /> 4. A copy of the agreement between Beltramo and AGUA covering this plan year, containing the <br /> amount and source of replacement water AGUA is dedicating to this plan, must be provided to <br /> this office within 30 days. <br /> 5. Releases of water by AGUA pursuant to this plan shall be coordinated with the Division <br /> Engineer and the Augmentation Coordinator and shall equal or exceed the depletions to be <br /> replaced on a monthly basis. <br /> 6. Accounting of water in this plan, including exposed surface area, aggregate production and <br /> water lost on aggregate, pumping for dust suppression, and replacement water deliveries <br /> must be provided to the Water Commissioner and Division Engineer on forms and at times <br /> acceptable to them. Said accounting must be received by the 10"' of the month following <br /> the month being reported. The name, mailing address, and phone number of the contact <br /> person who is responsible for operation and accounting of this plan must be provided on the <br /> accounting forms. <br /> 7. In accordance with amendments to Section 25-8-202-(7), C.R.S. and "Senate Bill 89-181 <br /> Rules and Regulations"adopted on February 4, 1992, the State Engineer shall determine <br /> whether or not the substitute supply is of a quality to meet requirements of use to senior <br /> appropriators. As such, water quality data or analysis may be requested at any time to <br /> determine if the water quality is appropriate for downstream water users. <br /> 8. This plan is valid through March 31, 2002, unless otherwise revoked,or modified. Any request <br /> for renewal of this plan must be submitted with the statutory fee then in effect at least 45 days <br /> prior to the date of expiration (February 14, 2002). Should this substitute water supply plan <br /> expire without renewal or be revoked prior to its expiration date, all uses must cease <br /> immediately. <br /> 9. This substitute water supply plan may be revoked or modified at any time should it be <br /> determined that injury to other water rights has or will occur as a result of this plan. <br />
