ALTERNATIVE SPECIFICATIONS MAY BE UTILIZED UNDER <br />THE PROVISIONS IN RULE 4.03.1(4)(e)(vi) IF THE APPLICANT <br />DEMONSTRATES THAT THESE SPECIFICATIONS WILL NOT RESULT IN <br />AN INCREASE IN EROSION. <br />This stipulation applies to future activities and is ongoing. <br />STIPULATION NO. 17 <br />A PERFORMANCE HOND IN THE AMOUNT OF $1,046,000.00 PAYABLE <br />TO THE STATE OF COLORADO LAND THE UNITED STATES GOVERNMENT/ <br />OFFICE OF SURFACE MINING, MUST BE FILED WITH THE DIVISION <br />AT LEAST 60 DAYS PRIOR TO INITIATING ANY DISTURBANCE <br />ASSOCIATED WITH PERMIT REVISION APPROVAL. NO DLSTURBANCE <br />SHALL OCCUR UNTIL THE PERFORMANCE HOND HAS HEEN APPROVED AND <br />ACCEPTED BY THE DIVISION. <br />This stipulation applies to future activities and is ongoing. Stipulation <br />No. I7 was placed on the approval of the permit to cover the crost of the <br />additional disturbance of the Central Facilities Area. Since this area has <br />not yet been built this stipulation remains in effect. The amount of <br />$1, 046 , 000.00 was a result of a revision during the renewal process and is <br />judged to be adequate during this mid-term review. <br />STIPULATION NO. 18 <br />A REPLACEMENT BOND IN THE AMOUNT OF $322,700.00 OR A BOND <br />RIDER INCREASING BOND COVERAGE FROM $307,630.00 TO $322,700.00, <br />MUST HE FILED WITHIN 30 DAYS PRIOR TO THE PERMIT RENEWAL DATE <br />OF JANUARY 12, 1988. THE REPLACEMENT BOND RIDER MUST BE MADE <br />PAYABLE TO THE STATE OF COLORADO AND THE UNITED STATES <br />GOVERNMENT OFFICE OF SURFACE MINING. <br />Stipulation NO. 18 was placed, on the permit during the renewal, to <br />increase the bond on the current disturbance. This in¢eased amount was <br />submitted as a certificate of deposit, and this stipulation has been <br />satisfied. <br />*STD?ULATION NO. 18 <br />THE DIVISION REQUIRES THE PERMITTEE TO SUBMIT DESIGNS FOR ALL <br />DITCHES DIVERTING DRAINAGE AROUND OR CONVEYING DRAINAGE FROM <br />THE MUNGER REFUSE DISPOSAL AREA AT LEAST SIXTY (60} DAYS PRIOR <br />TO ANY REFUSE DISPOSAL AREA CONSTRUCTION ACTIVITIES. THE <br />DITCHES SHOULD BE SIZED AND DESIGNED IN ACCORDANCE WITH RULES <br />4.10.3(2) AND (4.09.2(7). THE DITCH DESIGNS SHALL BE APPROVED <br />HY THE DIVISION PRIOR TO CONSTRUCTION. <br />This stipulation was attached to the permit application as a result of <br />approval of TR-06. This stipulation was erroneously numbered and will be <br />renumbered 19 as a result of this midterm review. <br />II. BONDING <br />The Division has reviewed both the amount of the bond and the conditions of <br />the bond for the Munger Canyon Mine in accordance with Rule 3.02 (4) and <br />2.05.4(2)(b). The current bond of $322,700.00 is judged to be sufficsent to <br />~mplete reclamation of mine in its present configuration. <br />6 <br />
